COTJNCIL <br />AN ORDINANCE PROVIDING FOR THE SUBMISSION TO <br />THE ELECTORS OF THE CITY OF NORTH OLMSTED OF <br />AN AMENDMENT TO SECTION 3 AND 4 OF ARTICLE VI <br />OF THE CHARTER OF THE CITY OF NORTH OLMSTED TO <br />CLARIFY THE DUTIES OF THE CIVIL SERVICE <br />COMMISSION, AS EXPRESSED IN SECTION 3 OF <br />ARTICLE VI, AS WELL AS TO CLARIFY THE RULE <br />MAKING POWERS OF THE CIVIL SERVICE COMMISSION, <br />AS EXPRESSED IN SECTION 4 OF ARTICLE VI, AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, the City of North Olmsted has been involved in two <br />(2) separate law suits dealing with the interpretation of the <br />duties of the Civil Service Commission, as well as the procedure <br />which the Civil Service Commission may follow with respect to <br />adopting rules and regulations; and <br />WHEREAS, this Council deems it advisable to propose an <br />amendment to the Charter for purposes of clarifying the duties of <br />the Civil Service Commission, as well as the procedure which must <br />be followed. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, TWO-THIRDS OF ALL MEMBERS <br />CONCURRING: <br />SECTION l: That pursuant to Article XVIII, Section 9 of the <br />Ohio Constitution and Article VII of the Charter of the City of <br />North Olmsted, this Council hereby authorizes and directs the <br />submission to the electors of the City of North Olmsted at an <br />election to be held at the usual places of voting in the City on <br />Tuesday, January 15, 1985, the following proposal to amend the <br />Charter of the City of North Olmsted: <br />That existing Section <br />amended to read as follows: <br />3 of Article VI of the Charter be <br />SECTION 3: DUTIES <br />The Civil Service Commission shall prescribe, amend, <br />and enforce rules for the classification of offices, <br />positions, and employment in the Civil Service of the City; <br />for examinations and resignations therefor; for <br />appointments, promotions, removals, transfers, lay-offs, <br />suspensions, reduction and reinstatment therein; for appeals <br />to the Commission; and for standardizing positions and <br />maintaining efficiency therein. Therefore, positions under <br />the Civil Service Commission shall be divided into <br />Classified and Unclassified Service. <br />A. The Unclassified Service shall include: <br />1. All officers <br />2. All directors <br />3. The members <br />appointed by <br />elected by the people. <br />of departments. <br />of all boards or commissions <br />the Mayor or the Council.
