' y <br />CITY GF NORTH OLMSTED <br />ORDINANCE N0. 84- 17 <br />BY: <br />AN ORDINANCE ADOPTING A NEW AND REVISED <br />CHAPTER 559 OF THE CODIFIED ORDINANCES OF <br />THE CITY OF NORTH OLMSTEU ENTITLEll "FALSE <br />ALARMS AND MALFUNCTIONING ALARM SYSTEMS". <br />WHEREAS, this Council previously adopted Ordinance 82-159 <br />dealing with the enactment of a new Chapter 559 relating to false <br />alarms; and <br />WHEREAS, since the adoption of this Ordir.ance this Council <br />has been advised by the Safety Director that some refinements are <br />necessary in order to make the Ordinance completely <br />comprehensive; and <br />WIiEKEAS, it is necessary to adopt a new and revised Chapter <br />559 to accomplish the purposes as recommended by the Safety <br />Director. <br />NOW 1HEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION l: That there is hereby created a new and revised <br />Chapter 559 of the Codified Ordinances of the City of North <br />Olmsted entitled "FALSE ALARMS ANT NiALFUNCTIONING ALARM SYSTEMS" <br />which said new and revised Chapter shall read as follows: <br />CHAPTER 559 <br />FALSE ALARMS ANll MALFUNCTIONING ALARM SYSTEMS <br />559.01 PURPOSE <br />Although an alarm system is important as a deterrent to <br />unlaT.aful entry, continued malfunctioning or employee error <br />compromise the effectiveness of the systen. Frequent <br />response by the police to these alarms is not only expensive, <br />but also creates a rislc of injury to the responding oificer <br />and others and a risk of damage to property. Based upon <br />these considerations, the purpose of this Ordinance is to <br />impose rnore drastic controls on alarm subscribers and users. <br />559.02 UEFINITIONS <br />(a) "False Alarm" - means ar? emergency alarm activatecl and <br />to which the North Olrnsted Police Departrnent responds which <br />is not in resgonse to actual or attempted burglary, holdup, <br />abgravated assault, unlawful entry or other bona fide <br />emergency requiring immediate police response. False alarms <br />include negligently or accidently activated alarms; alarms <br />which are activated to off premises locations by certain <br />noise levels which alarm is communicated to the Police
