PF'TR?GAC AN ORDINANCE PROVIDING FOR THE SUBMISSION TO THE ELECTORS OF THE CITY OF NORTH OLMSTED OF A PROPOSED AMENDMENT TO THE CHARTER OF THE CITY OF NORTH OLMSTED RELATING TO THE FILLING OF A VACANCY IN COUNCIL ANn DECLARING AN EMERGENCY WHEREAS, pursuant to the Charter of the City of North Olmsted and the Constitution of the State of Ohio, this Council has determined to authorize and direct the submission to the electors of the City of North Olmsted of a proposed Charter Amendment hereinafter set forth at the primary election to be held on May 8, 1984, which election is not less than 60 days nor more than 120 days from the date of the passage of this ordinance. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO, TWO-THIRDS OF ALL MEMBERS CONCURRING: SECTION 1: That this Council hereby authorizes and directs the submisslon to the electors of the City of North Olmsted at the primary election to be held at the usual places of voting in the City on Tuesday, May 8, 1984, the following proposal to amend the Charter of the City of North Olmsted: PROPOSAL: That Section S of Article IV entitled "Vacancies" be amended to include therein a provision for filling vacancies on council with a member of the same political party as the person who vacated said office, which amendment shall read as follows: ARTICLE IV Section 5: VACANCIES A. Whenever any office of Councilman becomes vacant, the vacancy shall be filled by appointment as hereinafter provided, by a majority vote of the remaining members of council eligible to vote to serve for the unexpired term, or until the election of a successor for the unexpired term at the next regular municipal election, provided that: (1) such election shall occur more than two years prior to the expiration of the unexpired term, and (2) the vacancy shall have occurred more than 75 days prior to the primary election. B. If the Councilman who vacates the council seat ran and was elected with a major party affiliation, namely, the Republican Party or the Democratic Party, the residents of the City who are members of the county central committee of that political party shall have the exclusive right to propose a candidate to fill that vacancy, provided that said proposed candidate's name is forwarded to the Council within the aforesaid 30 day period. In the event that the vacancy is not filled by a majority affirmative vote of Council within said 30 days, the Mayor shall appoint a person to fill such vacancy provided that the b4ayor's appointee shares the same party affiliation as that of the departing member.
