PF'TR?GAC <br />AN ORDINANCE PROVIDING FOR THE SUBMISSION <br />TO THE ELECTORS OF THE CITY OF NORTH <br />OLMSTED OF A PROPOSED AMENDMENT TO THE <br />CHARTER OF THE CITY OF NORTH OLMSTED <br />RELATING TO THE FILLING OF A VACANCY <br />IN COUNCIL ANn DECLARING AN EMERGENCY <br />WHEREAS, pursuant to the Charter of the City of North <br />Olmsted and the Constitution of the State of Ohio, this <br />Council has determined to authorize and direct the submission <br />to the electors of the City of North Olmsted of a proposed <br />Charter Amendment hereinafter set forth at the primary <br />election to be held on May 8, 1984, which election is not less <br />than 60 days nor more than 120 days from the date of the <br />passage of this ordinance. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO, <br />TWO-THIRDS OF ALL MEMBERS CONCURRING: <br />SECTION 1: That this Council hereby authorizes and directs <br />the submisslon to the electors of the City of North Olmsted <br />at the primary election to be held at the usual places of voting <br />in the City on Tuesday, May 8, 1984, the following proposal to <br />amend the Charter of the City of North Olmsted: <br />PROPOSAL: <br />That Section S of Article IV entitled "Vacancies" <br />be amended to include therein a provision for <br />filling vacancies on council with a member of the <br />same political party as the person who vacated <br />said office, which amendment shall read as follows: <br />ARTICLE IV <br />Section 5: VACANCIES <br />A. Whenever any office of Councilman becomes vacant, <br />the vacancy shall be filled by appointment as hereinafter <br />provided, by a majority vote of the remaining members of <br />council eligible to vote to serve for the unexpired <br />term, or until the election of a successor for the <br />unexpired term at the next regular municipal election, <br />provided that: (1) such election shall occur more than <br />two years prior to the expiration of the unexpired term, <br />and (2) the vacancy shall have occurred more than 75 <br />days prior to the primary election. <br />B. If the Councilman who vacates the council seat ran <br />and was elected with a major party affiliation, namely, <br />the Republican Party or the Democratic Party, the residents <br />of the City who are members of the county central committee <br />of that political party shall have the exclusive right <br />to propose a candidate to fill that vacancy, provided that <br />said proposed candidate's name is forwarded to the Council <br />within the aforesaid 30 day period. In the event that the <br />vacancy is not filled by a majority affirmative vote of <br />Council within said 30 days, the Mayor shall appoint a <br />person to fill such vacancy provided that the b4ayor's <br />appointee shares the same party affiliation as that <br />of the departing member.
