A01M% <br />CITY OF NORTH OLSMTED <br />ORDINANCE N0. 84--9 <br />PAGE 2. <br />SECTION 2: That this Ordinance in no way relieves the <br />City of Nort?i O1-msted of any of its responsibility, legal or <br />otherwise, for these roads (Section 723.01) O.R.C.). The County is only <br />assisting the City of North Olmsted in the areas covered by this <br />Ordinance. <br />SECTION 3: That in consideration of the performance of the <br />above mentioned roadway maintenance operations by the Office of the <br />County Engineer, the City of North Olmsted agrees to include the <br />Board of County Commissioners as an additional named insured in its <br />public liability and property damage insurance. The City of North <br />Olmsted agrees to furnish the Board of County Commissioners and the <br />County Engineer with a Certificate of Insurance naming the Board <br />as an additional insured; said insurance shall also provide for <br />thirty (30) days notification to the County Engineer in the event <br />of cancellation of the policy. It is expressly understood that the <br />scopQ of the rec{uired insurance coverage is limited to those risks <br />inherent in the roadway maintenance operation that are to be pre- <br />formed pursuant to this Ordinance of Consent. <br />SECTION 4: This Ordinance is hereby declared to be an <br />emergency Or?inance necessary for the immediate preservation of the <br />public health and safety; such necessity exists by reason of the <br />fact that freezing and thawing action has created hazardous <br />conditions on these roads, in consequence whereof public inconvenience <br />would be suffered and public travel endangered and delayed; and said <br />Ordinance shall take effect at the earliest time as provided by law <br />and upon acceptance by the Board of County Commissioners of Cuyahoga <br />County. <br />SECTION 5: That the Clerk of Council be, and is hereby, <br />directed tofurnish to the Cuyahoga County Engineer's Office a <br />certified copy of this Ordinance immediately upon the adoption <br />thereof. <br />PASSED: <br />ATTEST: <br />FLORENCE E.
