Nothing herein shall prevent individual <br />employees from discussing terms and conditions of employment <br />now covered by this Memorandum with the City, however, such <br />communication shall not be used to undermine the position of <br />the Union as the representative of the employees. <br />NON-DISCRIPiINATION <br />3. Both the City and the Union recognize their respective <br />responsibilities under the federal and state civil rights laws, <br />fair employment practice acts and other similar constitutional <br />and statutory requirements. Therefore, both the City and the <br />Union hereby reaffirm their commitments, legal and moral, not <br />to discriminate in any manner relating to employment on the basis <br />of race, color, creed, national origin, sex, age, or any other <br />invidious reason. <br />4. The City recognizes the right of all employees and all <br />applicants for employment to be free to join the Union and, partici- <br />pate in lawful, concerted tTnion activities. Therefore, the City <br />agrees that there shall be no discrimination, interference, <br />restraint, coercion, or reprisal by the City against any employee <br />or any applicant for employment because of Union membership or <br />because of any lawful activity in an official capacity on <br />behalf of the Union. The Union recognizes the right of all <br />employees and all applicants for employment to be free to join <br />or not to join the Union. <br />-2-
