M.. <br />s <br />? <br />. • » <br />CITY OF NORTH OLMSTED <br />ORDINANCE N0. 85- 47 <br />BY: COUNCIL OF THE CITY OF NORTH OLMSTED <br />AN ORDINANCE DIRECTING THE MAYOR, DIRECTOR OF <br />PUBLIC SERVICE, AND DIRECTOR OF LAW TO TAKE <br />WHATEVER MEANS ARE NECESSARY TO INSURE THAT <br />THE CITY OF NORTH OLMSTED CONTINUES TO RETAIN <br />CONTROL OVER ITS MUNICIPAL BUS LINE WHICH IS <br />PRESENTLY BEING THREATENED WITH TAKE-OVER BY <br />THE GREATER CLEVELAND REGIONAL TRANSIT <br />AUTHORITY AND DECLARING AN EMERGENCY. <br />WHEREAS, the City of North Olmsted has operated a municipal bus line <br />for over 50 years; and <br />WHEREAS, in 1975 the City of North Olmsted agreed in principle with <br />the operation of a regional transit authority; and <br />WHEREAS, because of its commitment to transit service the City entered <br />into an agreement with the Greater Cleveland Regional Transit Authority <br />after the same was formed; and <br />WHEREAS, that agreement provided that the City would continue to <br />operate the Municipal Bus Line by virtue of operating agreements and <br />subsidies with the Greater Cleveland Regional Transit Authority; and <br />WHEREAS, over the past few years the Greater Cleveland Regional <br />Transit Authority has sought to assume entire control of all transit <br />systems within the county; and <br />WHEREAS, this City is of the belief that the desire to control all <br />transit within the county is contrary to the public interest of the <br />citizens of the county; and <br />WHEREAS, because the City has over the years litigated various issues, <br />the Greater Cleveland Regional Transit Authority is limited with respect to <br />its options as is more fully set out in the Judgment Entry issued by the <br />Court of Common Pleas of Cuyahoga County; and <br />WHEREAS, those options include continuing an operating agreement, <br />buying out the interest of the City of North Olmsted and running parallel <br />and competing lines; and <br />WHEREAS, the City has expressed its disinterest in selling the assets <br />of the bus line to Greater Cleveland Regional Transit Authority and as a <br />result thereof the Greater Cleveland Regional Transit Authority has <br />threatened the running of parallel and competing lines as of September l, <br />19&5; and <br />WHEREAS, this Council is in complete disagreement with such activity <br />and therefore requests the above-named members of the administration to <br />take whatever steps are legally necessary to retain control of the North <br />Olmsted Municipal Bus Line.
