Immediately after <br />completing any Work, Grantee shall remove all machines, equipment <br />and personnel and, except as otherwise provided herein, shall <br />repair all damage caused by such Work and restore all areas <br />affected thereby to their condition prior to the commencement of <br />such Work, including, but not limited to, the replacement of soil <br />and parking lot materials with materials of like kind and quality. <br />Grantor reserves the right to approve in advance the methods <br />employed by Grantee in performing the Work with respect to any <br />portion of the sanitary sewer which is or will be located under or <br />near any building or other improvement or if said Work will <br />involve excavation or may result in any damage to Grantor's <br />property, which approval shall not be unreasonably withheld. <br />Furthermore, if such Work will require moving, removing, altering <br />or damaginq (collectively, "Removing") any improvement on <br />Grantor's property, then Grantor reserves the right to perform <br />such Removal at Grantor's sole cost and expense. If Grantor <br />elects to perform such Removal, it shall do so promptly so as not <br />to unreasonably delay the Work to be performed by Grantee. <br />The parties recognize and agree that Grantee is under <br />a duty to install, maintain and repair the Sanitary Sewer <br />within the Easement area; Grantor, however, desires to construct <br />a building and other improvements within, over, or about a portion <br />of the Easement area. The parties further recognize and agree <br />that said building, and any other improvements which Grantor <br />may construct within, over or about the Easement area, may, first, <br />cause damage to the Sanitary Sewer, and second, may increase <br />Grantee's normal cost and expense of installing, maintaining, <br />and/or repairing its sanitary sewers. Grantor therefore agrees <br />that it shall, first, be absolutely liable to Grantee for any <br />damage caused to the Sanitary Sewer within the Easement area <br />by reason of Grantor's construction of a building, or any other <br />improvement, over, within, or about the Easement area.
