_. ., . . .. _ _.., .? ? . _ _ <br />•4 <br />expenses of installing, maintaining and repairing the Sanitary <br />Sewer within the portion of the Easement area over, within <br />or about which is located Grantor's building and any other <br />improvements which Grantor may, from time to time, construct. <br />The parties agree that these "additional costs and expenses" <br />shall consist of the difference between the costs and expenses <br />of installation, maintenance and repair of the Sewer with <br />the building, and any other improvements constructed over, <br />within, or about the Easement area, and the normal cost and <br />expense of installing, maintaining, or repairing a sanitary <br />sewer accessible by an open cut, without any improvements <br />over, within or about its easement area. Grantor, upon demand, <br />shall promptly reimburse Grantee for any such additional <br />costs and expenses Grantee incures. <br />Further, the parties agree that Grantee shall not be <br />liable for any damage to Grantor's buildings or other improve- <br />ments, located over, within or about the Easement area, <br />resulting from its installation, maintenance or repair of <br />the Sanitary Sewer, so long as the damage was not caused <br />by the gross negligence or willful misconduct of Grantee's <br />employees. <br />TO HAVE AND HOLD the above granted easement and right-of-way <br />for the purpose and limited by the reservations above mentioned <br />unto Grantee, the City of North Olmsted, forever. <br />-4-
