. .. ?,... <br />Page 6 <br />' referral for employment, employment advancement, working condition, <br />rates of pay acceptance into Association membership or selection for <br />apprentice openings. 5.2 The Employer and the Association recognize the right of all <br />Employees to be free to join the Association, should theq so desire, <br />and to participate in lawful Association activities. The Employer <br />and the Association agree that there shall be no discrimination bq <br />the Employer or the Association against any Employee because of <br />Association membership or non-membership. <br />ABTICLE VI <br />Sules, Begulations and Orders <br />The Association agrees that its members shall comply with all Fire <br />Department rules, regulations and orders, including those relating <br />to conduct and work performance. <br />ARTICLE VII <br />Grievance Procedure <br />7.1 Every Employee shall have the right to present his Grievance in <br />accordance with the procedures provided herein, free from any <br />interference, coercion, restraint, discrimination or reprisal. It <br />is the intent and purpose of the parties to this Agreement that all <br />Grievances shall be settled at the lowest possible step of this <br />procedure. <br />7.2 The following procedures shall apply to the administration of all <br />Grievances filed under this Article. <br />A. Ezcept at Step 1 as detailed in this Article, Section 7.3, <br />all Grievances filed shall include the name and position of the <br />Aggrieved Party; the Article and section of this Agreement involved <br />in the Grievance; the time and place where the events or conditions <br />constituting the Grievance took place; the identity of the party <br />responsible for the Grievance, if known to the Aggrieved Party; and <br />a general statement of the nature of the Grievance and the redress <br />sought by the Aggrieved Party. <br />B. Except at Step 1, all decisions shall be rendered in <br />writing at each step of the Grievance Procedure. Each decision <br />shall be transmitted to the Aggrieved Party and his representative, <br />if any. <br />C. Zf a Grievance affects a group of Employees working in <br />different work locations, with different principles, or associated <br />with an Employer-wide controversy, it may be submitted at Step 3. <br />D. The preparation and processing of Grievances by Employees <br />shall be conducted only during off duty hours, unless agreed to <br />otherwise by the ranking individual authorized and present to hear <br />Grievances, the Shift Captain or designee or a higher authority <br />authorized to hear the Grievance. <br />
