_...?.,t,a,?, .. . ..., .. . . b ._..._ ._.,-, .. .,_, <br />Page S <br />ASTICLE III <br />Employer•s 8ights <br />3.1 Ezcept as specifically abridged by the ezpress written terms of this <br />Agreement, the Employer shall have all the rights and perogatives, <br />including, but not limited to the right to direct Employees covered <br />bp the Association•s jurisdiction, the right to determine the number <br />of Employees required ia the Fire Department, the right to hire, <br />fire, assign, transfer, promote, supervise and evaluate, demote and <br />discipline with just canse, the right to establish and enforce rules <br />not in conflict with the terms of this Agreement, to lay-off because <br />of lack of work or economic necessity, and to introduce new or <br />improved methods, equipment and facilities. <br />3.2 The above shall be in accordance with Civil Service Rules and <br />Segulations. <br />ARTICLE IY <br />Dues Deductions <br />4.1 The Employer agrees to deduct regular monthly Association dues from <br />the wages of those Employees who fiave voluntarily signed dues <br />deduction authorizatioa forms permitting said deductions. The dues <br />deductions shall be made from the second paycheck of every month. <br />4.2 The Employer aarees to deduct regular monthlq fees, hereinafter <br />referred to as a"Fair Share Fee", from the wages of those Employees <br />not belonging to the Association who have voluntarily signed <br />deduction suthorization forms permitting said deductions. The Fair <br />Share Fee shall not ezceed the dues paid by members of the <br />Association. The Fair Share Fee deduction shall be made from the <br />second paycheck of each month. <br />4.3 A check in the amount of the total dues and Fair Share Fees withheld <br />from those Employees authorizing dues and Fair Share Fees deductions <br />shall be tendered to the Treasurer of the Association within <br />fourteen Days from the date of the deductions. The Ecnployer shall <br />supply the Association with a list of those Employees for whom <br />deductions have been made. <br />4.4 The Association agrees to hold the Employer harmless from any and <br />all liabilities and damages which may arise from the performance of <br />its, the Employers, obligations under this Article and the <br />Association shall indemnify the Employer for any such liabilities or <br />damages that do arise. <br />ARTICLE V <br />Nondiscrimination <br />5.1 The parties to this Agreement agree to continue their policy of <br />nondiscrimination as required by applicable law based on sez, race, <br />creed, disability, national origin or age, regarding employinent,
