<br />.• .., <br />Page 8 <br />, Step 3- If the Aggrieved Party initiating the Grievance is not <br />satisfied with the written decision of the Fire Chief at the <br />conclusion of Step 2, awritten appeal of the decision may be filed <br />with the Safety Director within five Days from the date of the <br />written decision rendered by the Fire Chief at Step 2. Copies of <br />the writtea decision shall be submitted with the appeal. The Safetp <br />Director shall convene a hearing within seven Days of the receipt of <br />the appeal. The hearing will be held with the aggrieved Party and <br />his Association representative, if a representative is requested. <br />The Safety Director shall issue a written decision to the Employee, <br />and his representative if requested, within seven Days from the date <br />of the hearing. <br />Step 4- If the Aggrieved Party is not satisfied with the <br />written decision rendered at the conclusion of Step 3, a written <br />appeal of the decision may be filed with the Mayor within five Days <br />from the date of the decision in Step 3. Copies of the written <br />decisions shall be submitted with the appeal. The Mayor or his <br />designee shall convene a hearing within seven Days of the receipt of <br />the appeal. The hearing will be held with the Aggrieved Party and <br />his representative, if requested, and any other party(s) selected by <br />the Mayor to provide input on the Grievance. The Mayor shall issue <br />a written decision to the Employee and his representative, if any, <br />within seven Days from the date of the hearing. <br />Step 5- If agreement cannot be reached at Step 4, the <br />Aggrieved Party and his representative or the Employer may appeal <br />the Grievance to the Civil Service Commission. Should either the <br />Aggrieved Party or the Employer decide to appeal to the Civil <br />Service Commission it must notify the other party within ten Days of <br />the receipt of the Mayor•s written decision of its intent to proceed <br />to the Civil Service Commission. <br />Step 6- If an agreement cannot be reached at Step 5, the <br />Aggrieved Party or the Lmployer may appeal the Grievance to the <br />court system. Should the Aggrieved Party or the Employer decide to <br />appeal to the courts, it must notify the other party within 10 Days <br />of the receipt of Civil Service•s written decision of their <br />intention to appeal. <br />7.4 The ezpenses of court proceedings, including lawyers fees and <br />administration costs, shall be borne by the party against whom a <br />judgment is entered. <br />ABTICLE VIII <br />Personnel 8eduction <br />8.1 When a position in the Fire Department is abolished, and the <br />position is above the rank of Fire Fighter lst Class, the least <br />Senior officer in such rank shall be demoted to the next lower rank <br />and the least Senior officer in such lower rank shall be demoted, <br />and so on down until the least Senior person has been reached and he <br />shall be laid off.
