a <br />CITY OF NORTH OLMSTED <br />ORDINANCE N0. 85- 38 <br />BY: Mrs. Petrigac <br />AN ORDINANCE AMENDING SECTION 351.18 OF CHAPTER 351 <br />OF THE CODIFIED ORDINANCES OF THE CITY OF NORTH <br />OLMSTED, ENTITLED "PARKING GENERALLY," TO PROVIDE <br />FOR AN INCREASED PENALTY FOR VIOLATING SECTION <br />351.20, ENTITLED "HANDICAPPED PARKING", AS AMENDED. <br />WHEREAS, this Council desires to provide an increased penalty for <br />violations of Section 351.20 of the Codified Ordinances, entitled <br />"Handicapped Parking," to more strongly discourage non-handicapped persons <br />from illegally parking in locations designated for the exclusive use of the <br />handicapped; <br />NOW, THEREFORE BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH <br />OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That Section 351.18 of the Codified Ordinances of the City <br />of North Olmsted, entitled "Waiver Provisions," which now reads: <br />"351.18 WAIVER PROVISIONS <br />(a) Whoever violates any provision of this chapter shall be guilty of <br />a misdemeanor. Any such person who has received notice to appear and to <br />answer to such violation, upon filing personally with the Chief of Police <br />at the City Hall, a written plea of guilty, commonly known as a waiver, <br />within forty-eight hours after such notification, Sunday or holidays <br />excepted, may for such offense pay a fine of six dollars ($6.00) without <br />costs. If such written plea is made after forty-eight hours after such <br />notification, Sundays or holidays excepted, then such violator may pay a <br />fine of ten dollars ($10.00), without costs. <br />(b) Notwithstanding other waiver fees contained herein, any violator <br />of Section 351.13 or 351.14 may sign a waiver and pay for the first <br />offense, fifteen dollars ($15.00), and for each subsequent offense during <br />the same winter season, not less than twenty-five dollars ($25.00). <br />(c) Upon failure of a violator to appear and make such pleas as <br />aforesaid within a seventy-two hour period, a warrant may be issued for the <br />arrest of the violator and, upon conviction of the offense, such violator <br />shall be subject to the penalty provided in Section 303.99 of this Traffic <br />Code and all provisions incorporated herein." <br />Be and the same is hereby amended, and as amended shall read as follows: <br />"351.18 WAIVER PROVISIONS <br />(a) Whoever violates any provision of this chapter shall be guilty of <br />a misdemeanor.
