• ~. <br />4. You have the right to be informed at the initial contact <br />if you:are to be interrogated as a witness only. <br />5. You have the right, any time there is a formal internal <br />investigation, that if the interrogation is tape recorded, you also have <br />the right to make a separate tape recording. If no tape recording is used <br />by the interrogators, you do not have the right to make a separate tape <br />recording. <br />6. The interrogations shall take place at a location <br />designated by the Chief of Police and at a reasonable hour for all persons <br />concerned. <br />7. No polygraph test shall be administered without your <br />consent, and any polygraph agreed to must be given by a qualified <br />operator, except as described below. <br />Nothing shall preclude, upon recommendation of the Internal <br />Investigation Unit, the investigating supervisor or by the facts known by <br />the Chief of Police. The Chief of Police may order the officer or member <br />to submit to a polygraph examination which is specifically directed and <br />narrowly related to the complaint or allegation. However, when a <br />complaint or allegation from a citizen is the basis for the investigation, <br />the infraction is non-criminal, and no corroborating information has been <br />discovered in the investigation, the officer or member shall not be <br />required to submit to a polygraph examination unless the citizen also <br />submits to a polygraph examination which is specifically directed and <br />narrowly related to the complaint or allegation.
