<br />LAY-OFFS <br />37. Whenever it is necessary for the City to reduce its <br />forces, the employees within the department to be reduced will <br />be laid off the in the following order: <br />(a) Students: <br />(b) Part-time and seasonal employees; <br />(c) Employees. who have not completed their probationary <br />period. <br />(d) Regular full time employees within the classifi- <br />~_ <br />cation effected who have completed their probatio~ry <br />period. -~ <br />(e) In the application of the foregoing, employees will <br />be retained by reason of their seniority only if - <br />theyare able to perform the available work. <br />(f) For the purposes of this paragraph, students par- <br />ticipating in school or other subsidized related <br />work programs or employees working part time under <br />county or other subsidized programs shall not be <br />included in the definition of students under sub- <br />section a. or part-time employees under sub section b. <br />of this paragraph. <br />• 38. Regular full-time employees shall be laid off on the basis <br />of their seniority within their classification. When the seniority: <br />or service of two or more employees is equal, employees shall be <br />laid off by the drawing of lots. In the event an employee cannot <br />hold his present classification, he shall have the right to "bump" <br />an employee .with lesser seniority in an equal or lower rated classi- <br />fication within the City, provided the employee has the ability to <br />do the work of the classification. <br />39. Whenver practicable, a regular full-time employee shall be <br />given a minimum of two (2) weeks advance notice of a lay-off for <br />lack of work. ~ <br />40. In the event an employee is laid off for lack of work, he <br />shall receive payment for any earned but unused vacation as <br />quickly as practicable, but no later than fourteen (14) calendar <br />days after the lay-off. <br />-16- <br />
