~...,. <br />`~ <br />(b) An employee shall accumulate seniority during any <br />leave of absence, but he shall not be entitled to <br />any benefits, except hospital/surgical benefits <br />which shall be provided by the City on a one hundred <br />percent (100%) basis, minus ten dollars ($10) per <br />month deducted from first pay of each month, limited <br />to a three (3) month period after an initial thirty <br />(30) day waiting period. An employee must direct pay <br />any required hospital/surgical premiums to the City <br />on or before the monthly due date. =- <br />(c) When an employee returns to work after a leave of -~" <br />absence, he will be assigned to the position which <br />he formerly occpupied at the then current rate of <br />pay or to a similar position if his former position <br />no longer exists if he is physically qualified for <br />the job. In the event the City questions whether the <br />employee is physically able to do the work, it will <br />require the employee to furnish a medical certificate <br />of a physician supporting his claim of fitness, and <br />the City shall have the right to have the employee <br />examined by a doctor of its choice. If disagreement <br />thereafter edists, a third physician shall be mutually <br />selected by the Union and the City to determine the <br />issue, and the opinion of the third physician shall be <br />final on the parties. The charges made by the third <br />physician shall be shared equally by the City and the <br />Union. <br />36. If it is found that a leave of absence is not actually being <br />used for the purpose for which it was granted, the City shall <br />cancel the leave and it may impose disciplinary action up to and <br />including discharge. <br />-15- <br />
