<br /> <br /> <br />The Safety Committee shall have the authority <br />to deal with safety procedures, safety and sani- <br />tation problems, and shall decide upon the <br />protective equipment to be used under Paragraph A. <br />DISABLED EMPLOYEE <br />58. The City and the Union shall attempt through agree- <br />ment to place partially disabled employees on light-work <br />jobs which are available or become available during the term <br />of their disability, and which they are qualified to perform. <br />NO STRIKES <br />59. Neither the Union nor any employee or employees will ~:_ <br />T <br />either instigate, promote, sponsor, engage, or participate ~--- <br />in or condone any strike or work slow down. Any employee <br />who participates in, advances, leads or promotes a strike or <br />work slow down shall be subject to disciplinary action up to <br />and including discharge. <br />60. In the event that any breach of the No-Strike or <br />Work Slow Down cluase in Paragraph 59 above occurs, the <br />Union's officers shall publicly declare that the strike or <br />work slow down is unauthorized, shall promptly make reason- <br />able, earnest efforts to bring about a prompt termination of <br />the strike or work slow down, and shall continue such efforts <br />until the employees return to work. <br />MANAGEMENT RIGHTS <br />61. Except as they are specifically restricted or limited <br />by the express language of this Memorandum, the City shall <br />retain all of its rights, including without limitation of <br />the foregoing, the right to manage and direct the work force <br />and to determine the manner and method of performing the <br />work. <br />SAVINGS CLAUSE <br />62. The Union and the City recognize that North Olmsted <br />is a Home Rule City. Therefore, it is the intent of the <br />City and the Union that this Memorandum comply in every <br />respect with applicable legal statutes and charter require- <br />ments, and if it is determined that any provision of the <br />Memorandum is in conflict with law, that provision shall be <br />- 23 - <br />
