~..~,~. ,~ The Safety Committee shall have the authority to deal with safety procedures, safety and sani- tation problems, and shall decide upon the protective equipment to be used under Paragraph A. DISABLED EMPLOYEE 58. The City and the Union shall attempt through agree- ment to place partially disabled employees on light-work jobs which are available or become available during the term of their disability, and which they are qualified to perform. NO STRIKES _ 59. Neither the Union nor any employee or employees will ~:_ T either instigate, promote, sponsor, engage, or participate ~-._.. in or condone any strike or work slow down. Any employee who participates in, advances, leads or promotes a strike or work slow down shall be subject to disciplinary action up to and including discharge. 60. In the event that any breach of the No-Strike or Work Slow Down cluase in Paragraph 59 above occurs, the Union's officers shall publicly declare that the strike or work slow down is unauthorized, shall promptly make reason- able, earnest efforts to bring about a prompt termination of the strike or work slow down, and shall continue such efforts until the employees return to work. MANAGEMENT RIGHTS 61. Except as they are specifically restricted or limited by the express language of this Memorandum, the City shall retain all of its rights, including without limitation of the foregoing, the right to manage and direct the work force and to determine the manner and method of performing the work. SAVINGS CLAUSE 62. The Union and the City recognize that North Olmsted is a Home Rule City. Therefore, it is the intent of the City and the Union that this Memorandum comply in every respect with applicable legal statutes and charter require- ments, and if it is determined that any provision of the Memorandum is in conflict with law, that provision shall be -23-
