<br />Thence, South 39° 45' 00" Eat 4.54 feet along the easterly line of <br />land so conveyed to Ronald Wagner to an iron pin at the Southeasterly <br />corner thereof; <br />Thence, South 50° 15' 00" West 9.40 feet along the Southerly line of <br />land so conveyed to Ronald Wagner to a point; <br />Thence, North 48° 50' 16" West 2.87 feet to a point; <br />Thence, North 78° 53' 31" West 16.63 feet to a point; <br />Thence, South 68° 38' S6" West 11.23 feet to a point; <br />Thence, South 79° 29' 47" West 79.96 feet to a point; <br />Thence, South 67° 45' 00" West 57.91 feet to a point in the Westerly <br />line of land so conveyed to Ronald Wagner; <br />Thence, North 39° 45' 00" West 10.48 feet along the Westerly line of <br />land so conveyed to Ronald Wagner to the principal place of beginning, <br />containing within said bounds 1,764.841 square feet or 0.041 acres be <br />it the same more or less but subject to all legal highways. <br />As partial consideration herein, the Grantee hereby covenants and agrees <br />as follows: <br />FIRST; In the event the storm sewers and appurtenances hereinbefore <br />ref erred to should be altered, repaired or removed at any time, the land <br />shall be replaced in the same state of usefulness as it is at the date of <br />these presents. <br />SECOND, In the laying, construction and maintenance of said storm sewer, <br />all ditches, water courses, the drains and sewers interefered with shall be <br />replaced in their condition of usefulness, in the event of the settling of <br />the earth in the trench of said storm sewer, causing sewer or the drains to <br />settle, the same shall be replaced so as to put them in the same condition as <br />they were at the time they were disturbed when laying, constructing or <br />maintaining said storm sewer. <br />THIRD: All fences and other improvements on said easement to be replaced <br />and left in as good condition as at present, and this to apply to all future <br />repairs or construction work. <br />FOURTH: Grantor reserves~to himself, his heirs, administrators and <br />assigns, the right to use the property herein described, in any manner what- <br />soever, providing that such usage does not interefere in any way with the <br />special rights herein granted. <br />As partial consideration herein, the Grantee, its successors, assign or <br />persons designated by it, shall have the right at all times to enter upon <br />said land hereinbefore described for the purpose of inspecting, repairing, <br />PAGE TWO OF FOUR <br />
