? <br />T ' • <br />CITY OF NORTH OLMSTED <br />ORDINANCE N0. 88-94 <br />BY: Councilman Ron Tallon <br /> <br />AN ORDINANCE CREATING NEW AND REVISED CHAPTER 721 <br />OF THE NORTH OLMSTED CODIFIED ORDINANCES, ENTITLED <br />"PEDDLERS, SOLICITORS, CANVASSERS, AND TRANSIENT <br />VENDORS" AND DECLARING AN EMERGENCY AS AMENDED. <br />WHEREAS, this Council has this summer received a number of <br />complaints from City residents concerning the business activities and <br />conduct of transient vendors within the City of North Olmsted; and <br />WHEREAS, this Council wishes to regulate the said business <br />activity of transient vendors in order to protect the resident consumers <br />and further, to protect the aesthetics of the business community along and <br />about Lorain Road; <br />NOW, THEREFORE, BE IT ORDAINED by the City of North Olmsted, <br />County of Cuyahoga and State of Ohio: <br />Section 1.: That there be and hereby is created new and revised <br />Chapter 721 of the North Olmsted Codified Ordinances, entitled "Peddlers, <br />Solicitors, Canvassers, and Transient Vendors" which shall read as follows: <br />CHAPTER 721 <br />Peddlers, Solicitors, Canvassers, and Transient Vendors <br />721.01 DEFINITIONS; EXCEPTION. ' <br />(a) "Solicitor", "canvassser", "peddler" or "hawker" shall mean any <br />person who sells or offers for sale within the City any goods or chattels <br />of any kind, nature or description by going from house to house or from <br />place to place through the streets of the City with such goods or chattels <br />on his person or in his possession or under his control, or who sells by <br />subscription or by taking orders for future delivery of goods or chattels <br />of any kind, nature or description. This definition shall not apply to or <br />include minors under the age of eighteen years. <br />(b) "Transient Vendor" shall mean any person who, in.the usual course <br />of his business, transports inventory, stock of goods, or similar tangible <br />personal property to a temporary place of business within the City in which
