YVONNE PETRIGAC AND COUNCIL <br />AN ORDINANCE FORMALLY ACCEPTING THE PLAT OF NORTH OLMSTED <br />INDUSTRIAL PARK, AND THE DEDICATION OF NORTH OLMSTED <br />INDUSTRIAL PARKWAY AND CERTAIN EASEMENTS AS SHOWN ON THAT <br />PLAT, AND DECLARING AN EMERGENCY. <br />WHEREAS, Sunrise Development Co. and certain other owners of property <br />within North Olmsted Industrial Park presented a plat, a copy of which is <br />attached hereto as Exhibit A(the "Dedication Plat"), of the North Olmsted <br />Zndustrial Park providing for (i) the vacation of parts of certain streets <br />shown thereon as Sherman Avenue, West 308 Street, West 309 Street and West 310 <br />Street and (ii) the dedication of a new street thereon as North Olmsted <br />Industrial Parkway and certain easements of the City shown thereon, which plat <br />was approved by the City Engineer and, for recording purposes only, was <br />approved by the Planning Commission of this City and by this Council pursuant <br />to Ordinance No. 86-123 passed on December 2, 1986; and <br />WHEREAS, the Dedication Plat was filed for record on October 13, <br />1987, in Volume 239, at Pages 83 and 84 of the Plat Records in the office of <br />the Recorder of Cuyahoga County; and <br />WHEREAS, Sunrise Development Co. has heretofore prepared an assembly <br />plat, as copy of which is attached hereto as Exhibit B(the "Recorded <br />Assembly Plat"), for a portion of North Olmsted Industrial Park, which plat <br />was approved by the City Engineer and, for recording purposes only, was <br />approved by the Planning Commission of this City and by this Council; and <br />WHEREAS, the Recorded Assembly Plat was filed for record on April 15, <br />1988 in Volume 241, at Page 78 of the Plat Records in the office of the <br />Recorder of Cuyahoga County; and <br />WHEREAS, Sunrise Development Co. and certain other owners of property <br />within North Olmsted Industrial Park have presented an assembly plat, a copy <br />of which is attached hereto as Exhibit C(the "Unrecorded Assembly Plat" and, <br />together with the Recorded Assembly Plat, the "Assembly Plat") for the <br />remaining portion of North Olmsted Industrial Park, which Unrecorded Assembly <br />Plat has been approved by the City Engineer and the Planning Commission of <br />this City; and <br />WHEREAS, Sunrise Development Co. and those other property owners have <br />complied with all applicable provisions of the Codified Ordinances of the City <br />for the acceptance of the Assembly Plat and the dedication of North Olmsted <br />Industrial Parkway and certain easements of the City as shown on the <br />Dedication Plat and the Assembly Plat, including the filing of a petition <br />pursuant to Section 1101.11 of those Codified Ordinances; <br />NOW, THEREFORE, BE IT ORDAINED by the Council of the City of North <br />Olmsted, Cuyahoga County, Ohio, that: <br />Section 1. The petition of Sunrise Development Co. and the other <br />owners of the property within the North Olmsted Industrial Park to be assessed <br />for improvements to North Olmsted Industrial Parkway filed with this Council <br />is accepted. <br />Section 2. The Dedication Plat and the Assembly Plat are <br />incorporated herein by reference and those Plats and the dedication to public <br />use of North Olmsted Industrial Parkway and certain easements of the City as <br />shown on those Plats are formally approved and accepted.
