YVONNE PETRIGAC AND COUNCIL AN ORDINANCE FORMALLY ACCEPTING THE PLAT OF NORTH OLMSTED INDUSTRIAL PARK, AND THE DEDICATION OF NORTH OLMSTED INDUSTRIAL PARKWAY AND CERTAIN EASEMENTS AS SHOWN ON THAT PLAT, AND DECLARING AN EMERGENCY. WHEREAS, Sunrise Development Co. and certain other owners of property within North Olmsted Industrial Park presented a plat, a copy of which is attached hereto as Exhibit A(the "Dedication Plat"), of the North Olmsted Zndustrial Park providing for (i) the vacation of parts of certain streets shown thereon as Sherman Avenue, West 308 Street, West 309 Street and West 310 Street and (ii) the dedication of a new street thereon as North Olmsted Industrial Parkway and certain easements of the City shown thereon, which plat was approved by the City Engineer and, for recording purposes only, was approved by the Planning Commission of this City and by this Council pursuant to Ordinance No. 86-123 passed on December 2, 1986; and WHEREAS, the Dedication Plat was filed for record on October 13, 1987, in Volume 239, at Pages 83 and 84 of the Plat Records in the office of the Recorder of Cuyahoga County; and WHEREAS, Sunrise Development Co. has heretofore prepared an assembly plat, as copy of which is attached hereto as Exhibit B(the "Recorded Assembly Plat"), for a portion of North Olmsted Industrial Park, which plat was approved by the City Engineer and, for recording purposes only, was approved by the Planning Commission of this City and by this Council; and WHEREAS, the Recorded Assembly Plat was filed for record on April 15, 1988 in Volume 241, at Page 78 of the Plat Records in the office of the Recorder of Cuyahoga County; and WHEREAS, Sunrise Development Co. and certain other owners of property within North Olmsted Industrial Park have presented an assembly plat, a copy of which is attached hereto as Exhibit C(the "Unrecorded Assembly Plat" and, together with the Recorded Assembly Plat, the "Assembly Plat") for the remaining portion of North Olmsted Industrial Park, which Unrecorded Assembly Plat has been approved by the City Engineer and the Planning Commission of this City; and WHEREAS, Sunrise Development Co. and those other property owners have complied with all applicable provisions of the Codified Ordinances of the City for the acceptance of the Assembly Plat and the dedication of North Olmsted Industrial Parkway and certain easements of the City as shown on the Dedication Plat and the Assembly Plat, including the filing of a petition pursuant to Section 1101.11 of those Codified Ordinances; NOW, THEREFORE, BE IT ORDAINED by the Council of the City of North Olmsted, Cuyahoga County, Ohio, that: Section 1. The petition of Sunrise Development Co. and the other owners of the property within the North Olmsted Industrial Park to be assessed for improvements to North Olmsted Industrial Parkway filed with this Council is accepted. Section 2. The Dedication Plat and the Assembly Plat are incorporated herein by reference and those Plats and the dedication to public use of North Olmsted Industrial Parkway and certain easements of the City as shown on those Plats are formally approved and accepted.
