CITY OF NORTH OIMSTID <br />ORDINAL NO. 91 - 159 <br />By: Council Member Tallon <br />AN ORDINANCE TO A2~ID SDGTIONS 901.01, 901.06 AMID 901.07 <br />OF THE CODIFIID ORDINANCES OF' Tim CITY OF NORTH OIMSTED. <br />BE IT ORDAINED by the Council of the City of North Olmsted, Cuyahoga <br />County, State of Ohio that: <br />SECTION 1: Section 901.01 of the Codified Ordinances of the City of North <br />Olmsted, Ohio, which now reads as follows: <br />"901.O1-.PERMIT-REQUIRED• FEE-AND-APPLICATION. <br />No person sha make any opening in any street, boulevard, avenue or <br />public place in the City until such person has filed with the City Engineering <br />Division a written or printed application setting forth and indicating therein <br />the location, kind and extent of the pavement desired to be taken up, and the <br />number, purpose and size of openings or excavations which are desired or <br />necessary. The applicant shall pay to the City the sum of Five Dollars ($5.00) <br />for the General Fund before the permit is issued and shall deposit with the <br />City an additional amount sufficient to cover the cost of repairing or relaying <br />and also the cost of materials needed for repairing or relaying the tree lawn, <br />roadway or paving removed or damaged as a result of work done on or under the <br />streets and public rights of way of the City, plus fifteen percent for the <br />cost of inspection and general supervision, as shall be estimated by the <br />Engineering Division of the City." <br />BE AND THE SAME IS HEREBY AMENDED AND AS AMENDED SHALL READ AS FOLLOWS: <br />"901.01 PE&MIT REQUIRED;. FEE AND-APPLICATION. <br />No person shall make any opening in any street, boulevard avenue or public <br />place in the City until such person has filed with the City Engineering <br />Division a written or printed application setting forth and indicating therein <br />the location, kind and extent of the pavement desired to be removed, and the <br />number, purpose and size of openings or excavations which are desired or <br />necessary. The applicant shall pay to the City the sum of Twenty-Five Dollars <br />($25.00) to the General Fund before the permit is issued and shall deposit with <br />the City an additional amount sufficient to cover the cost of repairing or <br />relaying and also the cost of materials needed for repairing or relaying the <br />tree lawn, roadway or paving removed or damaged as a result of work done on or <br />under the streets and public rights of way of the City, plus fifteen percent <br />(15%) for the cost of inspection and general supervision, as shall be estimated <br />by the Engineering Division of the City." <br />SECTION 2: Section 901.06 of the Codified Ordinances of the City of North <br />Olmsted, which currently reads as follows: <br />"901.06 -INSUFFICIENT DEPOSIT <br />If the deposit is insufficient to reimburse the City, the Engineering <br />Division shall collect from the applicant a sufficient amount to reimburse the <br />City for the expense incurred." <br />
