Ord. 91-159, Page 2 BE AND THE SAME IS HEREBY AMENDED, AND AS AMENDED, SHALL READ AS FOLLOWS: "901.06_-INSUFFICIENT .DEPOSIT If the deposit is insufficient to reimburse the City, the Engineering Division shall collect from the applicant a sufficient amount to reimburse the City for the expense incurred. If the applicant fails to deposit sufficient funds to reimburse the City for the cost of inspection and general supervision or anticipated repairs within three (3) days of notice to do so, then the City Engineer may issue an order to stop work for all or part of the work associated with the street opening. Failure to heed such stop work order shall be cause to revoke the permit to open the street." SECTION.3: Section 901.07 of the Codified Ordinances of the City of North Olmsted, which currently reads as follows: "901.07_..TREE_LP,WN OPENINGS•_PERMIT.AND.FEE. If an application is ma e for a permit to open a street in a tree lawn, then the applicant shall make the payment of five dollars ($5,00) for a permit and shall deposit with the Finance Department fifteen dollars ($15.00) per square yard based on the size of the opening, as a guarantee that he will restore the tree lawn to its original condition or pay the City for restoring the same. Such deposit, less the cost of inspection, shall be returned to the person, firm or corporation making the sane upon the issuance of a certificate by the City Engineer that the tree lawn has been restored to the same condition as before the opening was made." Such deposit, less the cost of inspection, shall be returned to the person, firm or corporation making the same upon the issuance of a certificate by the City Engineer that the tree lawn has been restored to the same condition as before the opening was made." SECTION-4: Any ordinance or part of ordinances inconsistent herewith are hereby repe~ed. SECTION-5: This ordinance shall take effect and be in force from and after the earliest date allowed by law.
