,- CITY OF NORTH OLMSTID ORDINANCE N0. 91-.148 BY: Mayor Ed Boyle AN ORDINANCE AUTHORIZING AND DIRECTIlVG THE MAYOR OF THE CITY OF NORTH o~TID TO ENTER INTO AN AGREENIEIVT WITH MALCOM PIRNIE, INC. TO PROVIDE ENGINEERING SERVICES FOR A FACILITY PLAN FOR THE WASTEWATER TREATMENT PLANT, AND DECLARING AN EMEttGENCY. WHEREAS, this Council is aware of the fact that the Ohio Environmental Protection Agency has ordered the City to study the capacity and efficiency of the Wastewater Treatment Plant; and WHEREAS, the Mayor has recommended that the services of the engineering firm Of Malcom Pirnie Inc be hired to accomplish the aforesaid project due to their expertise in this field; and WHEREAS, upon the recommendation of the Mayor, this Council does hereby express its desire to have the Mayor enter into a contract with said firm for and on behalf of the City. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTID, COUNTY OF CUYAHOGA, AND STATE OF OHIO: SECTION 1: That the Mayor be and he is hereby authorized and directed to enter into and agreement with Malcom Pirnie, Inc, for the purpose of a facility plan for the Wastewater Treatment Plant. A copy of said agreement is attached hereto and made a part hereof and marked Exhibit A. SECTION 2: That this Ordinance is hereby declared to be an emergency measure immediately necessary for the preservation of the public health, safety and welfare, and for the further reason that it is immediately necessary to proceed with the water quality study on selected metals, and further provided it receives the affirmative vote of two-thirds of all members elected to Council, it shall take effect and be in force immediately upon its passage and approval by the Mayor.
