,- <br />CITY OF NORTH OLMSTID <br />ORDINANCE N0. 91-.148 <br />BY: Mayor Ed Boyle <br />AN ORDINANCE AUTHORIZING AND DIRECTIlVG THE MAYOR OF THE CITY OF NORTH <br />o~TID TO ENTER INTO AN AGREENIEIVT WITH MALCOM PIRNIE, INC. <br />TO PROVIDE ENGINEERING SERVICES FOR A FACILITY PLAN FOR THE WASTEWATER <br />TREATMENT PLANT, AND DECLARING AN EMEttGENCY. <br />WHEREAS, this Council is aware of the fact that the Ohio Environmental <br />Protection Agency has ordered the City to study the capacity and <br />efficiency of the Wastewater Treatment Plant; and <br />WHEREAS, the Mayor has recommended that the services of the engineering <br />firm Of Malcom Pirnie Inc be hired to accomplish the <br />aforesaid project due to their expertise in this field; and <br />WHEREAS, upon the recommendation of the Mayor, this Council does hereby <br />express its desire to have the Mayor enter into a contract with said <br />firm for and on behalf of the City. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH <br />OLMSTID, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Mayor be and he is hereby authorized and directed to <br />enter into and agreement with Malcom Pirnie, Inc, for the <br />purpose of a facility plan for the Wastewater Treatment Plant. A copy <br />of said agreement is attached hereto and made a part hereof and marked <br />Exhibit A. <br />SECTION 2: That this Ordinance is hereby declared to be an emergency <br />measure immediately necessary for the preservation of the public health, <br />safety and welfare, and for the further reason that it is immediately <br />necessary to proceed with the water quality study on selected metals, <br />and further provided it receives the affirmative vote of two-thirds of <br />all members elected to Council, it shall take effect and be in force <br />immediately upon its passage and approval by the Mayor. <br />ATTF,,S,T <br />L.
