• <br />r <br />SECTION-4: Section 911.16 of the Codified Ordinances of the City of <br />North Olmsted, which currently reads in part as follows: <br />911.16 POWERS AND AiJ'ITiORITY OF 1NSPECTORS . <br />(a) The Service Director, Building Commissioner and City Engineer <br />and other duly authorized employees bearing proper credentials and <br />identification shall present same to the owner, agent or present <br />occupant of properties within the City before entering for the purpose <br />of inspection, observation, measurement, sampling and testing, in <br />accordance with the provisions of this chapter. The Service Director, <br />Building Commissioner and City Engineer or his representative shall also <br />obtain a proper search warrant if the owner, agent or present occupant <br />request same. An request by the owner, agent or present occupant that <br />the Service Director, Building Commissioner and City Engineer or his <br />representative obtain a search warrant i.s an exercisable right of the <br />requesting party and shall not constitute failure to cooperate for the <br />purpose of this chapter nor shall it constitute a failure to comply with <br />the provisions of these Codified Ordinances. The Service Director, <br />Building Commissioner and City Engineer or his representatives shall <br />have no authority to inquire in to any processes including <br />metallurgical,chemical, oil, refining, ceramic, paper or other <br />industries beyond that point of having a direct bearing on the kind and <br />source of discharge into the sewer or waterways to facilities for waste <br />treatment. <br />BE AND TfB; SAME IS HEREBY AMEDIDID, AND AS AMENDID SHAT,T, j~D AS FOLLOWS <br />911.16 POWERS A1~ID AUTHORITY OF INSPECTORS. <br />(a) The Service Director, Building Commissioner and City Engineer <br />and other duly authorized employees bearing proper credentials <br />and identification shall present same to the owner, agent or present <br />occupant of properties within the City before entering or the purpose of <br />inspection, observation, measurement, sampling and testing, in <br />accordance with the provisions of this chapter". <br />SECTION 5: Any ordinance or part of ordinances inconsistent <br />herewith are hereby repealed. <br />PASSES : ~ c,v ~~"' ~ a / ~ Q <br />SECTION 6: This ordinance shall take effect and be in force from <br />and after the earliest date allowed by law. <br />T: ~~, <br />f -~- ~ ~~ <br />Barbara L.
