Excspt as Grantee deems necessary for surface and subsurface <br />water drainage purposes or as otherwise needed in the exercise of <br />Grantees easement rights hereunder, Grantee, upon the exercise <br />of any o! its rights under this Easement, shall restore the <br />Easement Urea to its condition prior to any acts by Grantee, as <br />i• reasonably practicable. <br />Grantee shall indemnify and save Grantor harmless from and <br />against any claims, losses, costs, damages, liabilities and <br />expanses, causes of action, claims, demands or judgments directly <br />arising lrom or caused by Grantees use of-the Easement Urea. <br />Grantor shall cause any existing mortgage upon Grantor~• <br />Parcel to be subordinated to Grantae~s rights under this Grant of <br />Easements by an instrument satisfactory in form and substance to <br />Grantee. <br />Ths easements granted herein and all of the terms, <br />restrictions, covenants and agreements sat lorth in this Easement <br />era intended to be and shall be construed as covenants (and not <br />conditions) running with the land and shall be binding upon and <br />shall inure to the benefit of and be enforceable by Grantor and <br />Grantee and their respective hairs, successors or assigns. <br />Grantor covenants that (a) Grantor ie the owner of the <br />Property and Easement l~irea; (b) Grantor has the right, title and <br />
