CITY OF NORTH OLMSTED ORDINANCE NO. 91-88 BY: COUNCILMAN JANET SARINGER AN ORDINANCE AMENDING CHAPTER 1135 ENTITLED ONE AND TWO-FAMILY RESIDENCE DISTRICT BY ADDING A NEW SECTION 1135.08(B)5 PROVIDING FOR EXCEPTION TO THE REAR YARD REQUIREMENTS WHERE THERE IS AN EXISTING STAIRWELL. WHEREAS, the Building Commissioner, in reviewing the newly adopted Zoning Code, which was adopted by virtue of the passage of Ordinance 90-125, has discovered that there aze certain circumstances where it is desirable for the construction of a cover over reaz stairwells in certain azeas of the City so as to diminish flooding problems, and WHEREAS, the Building Zoning and Development Committee of Council has consid- ered the suggestion of the Building Commissioner to amend the Zoning Code to permit the stairwell enclosure, and WHEREAS, it is the desire of this Council to amend the Zoning Code to include the aforesaid provisions, and WHEREAS, after careful consideration, the Planning Commission of the City, on the ~/ day of , 1991, recommended approval of the aforesaid amendment to the Zoning Code. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: SECTION 1: That 1135.08, entitled Reaz Yazd Requirements of Chapter 1135 entitled One and Two-Family Residence District, which now reads: " 1135.08 REAR YARD REQUIREMENTS. A. Minimum Depths. In One and Two Family Residence Districts, the mini- mum depth of the reaz yazd shall be 50 feet. B. Computation of Depths. In computing the minimum rear yazd requirements, the following rules shall prevail: 1. The depth required shall be determined exclusive of any portion used for accessory structures. 2. In case the reaz lot line is not parallel with the street line, the average depth shall be used. 3. On a through lot, the setback requirements set forth in Section 1135.06 shall prevail and not the rear yazd requirements of this section. 4. A cornice projecting not more than 24 inches or a fence shall not reduce the required minimum distance. " Be and the same is here amended and as amended shall read as follows:
