<br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 93 -140 <br />BY.• MAYOR BOYLE AND THE ENTIRE CITY COUNCIL <br />AN ORDINANCE AMENDING THE ZONING CODE OF THE <br />CITY OF NORTH OLMSTED BY ADDING THERETO A NEW <br />SECTION 1139.11 OF CHAPTER 1139, ENTI7ZED <br />"REGULATION OF SUPERSTORES" AS AMENDED. <br />WHEREAS, this Council believes that the recent phenomenon of proposed "Superstore" <br />construction in the City poses a risk of injury to the general public health, safety and welfare, <br />if not properly regulated within the City Zoning Code; and <br />WHEREAS, this Council accordingly desires to amend the City of North Olmsted Zoning <br />Code in order to regulate Superstore construction in the City of North Olmsted by restricting <br />locations and imposing other reasonable conditions so that the City's infrastructure will not be <br />adversely impacted and so that City residents can be assured of safe traffic conditions in and <br />about the vicinity of any such Superstore location; and <br />p? WHE?1S, after careful consideration, the Planning Commission of the City, on the <br />0- day of 1993, recommended approval of the aforesaid amendment to the <br />Zoning Code. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That there is hereby created a new Section 1139.11 of the North Olmsted <br />Zoning Code entitled "Regulation of Superstores," which, as created, shall read as follows: <br />Section 1139.11 Regulation of Superstores. <br />(a) "Superstore" means a wholesale or retail discount store carrying a multiple product <br />line, which (1) has 100,000 or more square feet of gross floor area, either free standing <br />or as part of a shopping store development, or (2) is standing alone on a lot of ten or <br />more acres.
