.. <br />CITY OF NORTH OLMSTED <br />ORDINANCE N0.2011 - 17 <br />By: Mayor Kennedy <br />AN ORDINANCE PURSUANT TO ARTICLE XVI OF THE <br />CHARTER MODIFYING ARTICLE VII, BOARDS AND <br />COMMISSIONS, ~3 PARKS AND RECREATION <br />COMMISSION OF THE CHARTER OF THE CITY OF <br />NORTH OLMSTED IN ORDER TO ELIMINATE AS <br />OBSOLETE THE NOW ABOLISHED POSITION OF <br />DIRECTOR OF COMMUNITY LIFE SERVICES AS A <br />MEMBER OF THE COMMISSION AND FURTHER TO <br />REDUCE THE COMMISSION MEMBERSHIP TO SIX (6) <br />MEMBERS AS A RESUL T OF THE ELIMINATION. <br />WHEREAS, at the primary election held on May 4, 2010, residents of North Olmsted <br />approved ballot Issue 34, amending the Charter by removing from Charter Article V, <br />Administrative Officers and Departments, the position of, among others, Director of Community <br />Life Services (Charter Article V, §6), thereby leaving only the Director of Law and Director of <br />Finance as Charter mandated positions; and <br />WHEREAS, on or about June 15, 2010, the Council adopted and Mayor Kennedy <br />approved Ord. 2010-61, an Ordinance abolishing Chapter 163 of the Administrative Code <br />entitled Department of Community Life Services, thereby eliminating the position of Director of <br />Community Life Services; and <br />WHEREAS, pursuant to its powers as granted in Charter Article XVI, §(b)(1), Duties <br />and Powers, the Charter Review Commission on June 10, 2010, issued a report recommending <br />to Council that Charter Article VII, §3, Parks and Recreation Commission, be amended pursuant <br />to Charter Article XVI, §2, Nonsubstantive Charter Language, so as to delete from membership <br />of the Parks and Recreation Commission, the now-obsolete position of Director of Community <br />Life Services; and <br />WHEREAS, the Director of Law, on February 03, 2011, provided this Council with a <br />formal legal opinion, concluding that eliminating from the membership of the Parks and <br />Recreation Commission the individual holding the position of Director of Community Life <br />Services and necessarily reducing the membership by one member could legally be accomplished <br />by ordinance, pursuant to Article XVI of the Charter; and <br />WHEREAS, in accordance with the provisions of Article XVI of the Charter, this <br />legislation proposing to remove from membership of the Parks and Recreation Commission the <br />Director of Community Life Services, as a nonsubstantive charter language change, has been <br />advertised by title and text in a newspaper of general circulation within the City on three separate <br />dates with at least two weeks separating each publication; and <br />
