WHEREAS, a public hearing, occurring no later than thirty days after, and no earlier than <br />five days before the last publication of notice, and further occurring between the first and third <br />readings of this Ordinance, has been held on ~ ' , 2011; and <br />WHEREAS, it is the desire of this Council, acting in accordance with the provisions of <br />Article XVI of the Charter to eliminate from membership of the Parks and Recreation <br />Commission the individual holding the position of Director of Community Life Services and <br />further to reduce the Commission membership to six (6) members from seven (7) members, all as <br />established and created by Charter Art. VII, §3, Parks and Recreation Commission. <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That City of North Olmsted Charter Article VII, §3, Parks and Recreation <br />Commission, which presently reads as follows: <br />The Parks and Recreation Commission shall consist of seven (7) members who shall <br />serve without compensation. The Mayor, subject to confirmation by Council, shall appoint two <br />(2) members who are qualified electors and residents of North Olmsted and who do not hold any <br />other elected or appointed public office and are not employees of the City. Council shall appoint <br />one (1) member who shall be a member of Council and one (1) member who shall be a qualified <br />elector and resident of North Olmsted and who does not hold any other elected or appointed <br />public office and is not an employee of the City. <br />The North Olmsted City School District Board of Education shall appoint one (1) <br />member who shall be a member of such Board of Education and one (1) member who shall be a <br />qualified elector and resident of North Olmsted and who does not hold any other elected or <br />appointed public office and is not an employee of the School District. The Director of <br />Community Life Services shall be a member of said Parks and Recreation Commission. Each of <br />the appointed members of said Commission shall be appointed for a term of five (5) years, <br />except that of the six (6) members appointed for the term beginning January 1, 1971, the City <br />Council shall appoint one (1) member for a term of one (1) year and one (1) member for a term <br />of four (4) years, the Board of Education shall appoint one (1) member for a term of two (2) <br />years and one (1) member for a term of five (5) years. In the event that a Board of Education <br />member or Council member, who has been appointed to the Parks and Recreation Commission, <br />ceases to be a member of the Board of Education or Council for any reason, then such <br />appointee's membership on the Parks and Recreation Commission shall terminate forthwith. A <br />vacancy occurring during the term of any member of the Parks and Recreation Commission shall <br />be filled for the remainder of the unexpired term in the manner authorized for the original <br />appointment. The terms of the members of the present Recreation Commission shall expire at <br />the end of the organizational meeting of the Parks and Recreation Commission in January 1971. <br />The powers and duties of the Parks and Recreation Commission shall be: <br />(a) Develop and approve all recreation programs under the control of the City of North <br />Olmsted <br />2 <br />
