the continuing professional relationship between the City and the law firm of Johnson, <br />Miller & Schmitz LLP, and the Mayor be and he hereby is authorized to enter into a <br />contract with Johnson, Miller & Schmitz LLP, to provide labor negotiator services to the <br />City for the City's labor contracts with terms ending in 2011 and 2012. <br />SECTION 2: That the said contract shall be in final form and substance <br />substantially the same as the Agreement for Labor Negotiator and Outside Legal Services <br />attached to this Ordinance as "Exhibit A," with only such changes thereto in the form and <br />substance of the Agreement that are not substantially adverse to the City. The character <br />of any such changes as not being substantially adverse to the City shall be evidenced <br />conclusively by the execution of the Agreement by the Mayor and the approval of the <br />Agreement by the Director of Law. In addition, the Agreement shall provide for Johnson, <br />Miller & Schmitz LLP to provide labor negotiator services only, and not outside legal <br />services. <br />SECTION 3: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and <br />for the reason that the City must timely respond to negotiations beginning in the fall of <br />2011; and further provided it receives the affirmative vote oftwo-thirds of all members of <br />Council, it shall take effect and be in force immediately upon its passage and approval by <br />the Mayor. <br />~C/U~~ First Readin <br />PASSED: ~ , g: ~ ~l l <br />Second Reading: ~ ~ l <br />Third Reading: ~' (l <br />Committee: ~ '1~ <br />ATT T: <br />MARIE GALLO <br />Clerk of Council <br />APPROVED: ~~~5 ~d-~ L J <br />~,.1_ <br />YOR KEVIN VI.
