WHEREAS, the anticipated cost of the services for a twelve (12) month period is $118,876.00; and WHEREAS, this Council, acting upon the recommendation of the Director of Public Service and the City Engineer, desires to dispense with the RFP process otherwise required by Chapter 112 of the North Olmsted Codified Ordinances and authorize the Mayor to enter into a contract with Professional Services Industries, Inc. to provide construction material testing and special observation services. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: SECTION 1: That the formal RFP process required by Chapter 112 of the Codified Ordinances of the City of North Olmsted is hereby dispensed with for the reasons set forth in this ordinance, and the Mayor be and he hereby is authorized to enter into a contract with Professional Services Industries, Inc. to provide construction material testing and special observation services. SECTION 2: Attached hereto as Exhibit A is the proposal from PSI, which accepted terms shall be incorporated into a contract negotiated by the Director of Law and executed by the Mayor. SECTION 3: That this Ordinance is hereby declared to be an emergency measure immediately necessary for the preservation of the public health, safety and welfare, and for the reason that the City must timely commence construction processes in the winter of 2012; and further provided it receives the affirmative vote oftwo-thirds of all members of Council, it shall take effect and be in force immediately upon its passage and approval by the Mayor.
