_ (b) Any owner or occupier of property within the City may place, cause to be placed, or <br />permit to be placed, garbage or rubbish receptacles as defined in subsection (a) hereof, within the <br />public right of way; provided that such receptacles are placed within a treelawn or other suitable <br />area within the public right of way; and further provided that such receptacles are so placed no <br />earlier than upon the evening preceding collection by the City of the street which the treelawn or <br />other area abuts, and removed from the area no later than by 10:00 p.m. of the date of collection. <br />(c) Any owner or occupier of property within the City may apply to the Director of Public <br />Service for a permit to be exempted from the provisions of subsection (b) hereof on the basis of <br />hardship. <br />(d) The provisions of subsection (b) hereof shall not be construed to apply to the placement <br />of brush or leaves within treelawn or other suitable areas of the public right of way. <br />(e) A violation of either subsections (a) or (b) hereof is a minor misdemeanor, and each day <br />during which such a violation continues shall constitute a separate offense. <br />941.03 STORAGE OF REFUSE - COMMERCIAL ESTABLISHMENTS. <br />Whenever refuse is generated as a result of the operation of commercial establishments as <br />hereinbefore specified, all such refuse shall be immediately placed in containers provided for <br />such refuse, and in no event shall any individual owner or operator of a commercial <br />establishment cause the refuse to be placed or stored in an area other than that designated for <br />such refuse, and further such refuse shall be placed in containers consistent with those provided <br />for in Section 941.01(c)(3). <br />941.04 PLACEMENT AND COLLECTION OF RECYCLABLE MATERIALS <br />(a) Occupants of residential units shall separate accumulated recyclable materials according <br />to the following categories: <br />(1) Clear and colored glass, aluminum and steel cans, and numbers "1" and "2" <br />stamped plastic containers; and <br />(2) Newspapers <br />Occupants shall place their stamped materials within blue colored plastic bags and these <br />materials shall be placed within the public right of way for collection. As defined for purposes <br />of this section, the public right of way appropriate for placement and collection of recyclable <br />materials shall be limited to residential curbside treelawns. Such recyclable materials shall be so <br />placed in the public right of way no earlier than the evening preceding collection by the City of <br />the street which the treelawn or other area abuts. The date or day for collection of recyclable <br />materials for an occupant of a residential unit shall correspond to the date or day of collection of <br />garbage or rubbish.
