EXHIBIT <br /> <br />RESIDENTIAL LEASE <br />This Lease made and entered into at North OLmsted, Ohio, this _ day of March, 2012, by <br />a.nd between THE CITY OF NORTH OLMSTED, 5200 Dover Center Road, North Olmsted, Ohio <br />(hereinafter referred to as "Lessor") and RONALD J. MAYLE and CHRISTINA MAYLE, 0£3827 <br />Dovez Center Road, Narth Olmsted, Qhio (hereinafter referred to jointly as "Lessees"). <br />LEASE <br />Witnesseth: Lessor hereby lease to Lessees, and the latter Iets from the former, #he residential <br />premuises located at 3827 Dover Center Road, North Olmsted, Ohio 44070 (hereinafter referred to as <br />"the Property"), and described in Exhibit A and known as being Permanent Parcel No. 232-21-019. <br />Item One. Term of Lease. The term of this Lease shall be for a term of ten (10) months, <br />camxnencing on May 1, 2012, and terminating on March 1, 2013; in additian, the Lease may <br />thereafter be continued from month to rnonth, at the Lessor's sole option, commencing on the 1 st da.y <br />of March, 2413, for consecutzve, renewable thirty (30) day periods. The Lease sha11 fierminate <br />effective March 1, 2013, and Lessee shall vacate Premises on or prior to said date unless Lessee <br />exercises and issues written notice of said month to month extension. The parties agree that this <br />Lease shall be limited to a single term of 10 months, subject to Lessor's option to extend by <br />additional month to month thirty (30) day terms, subject however to renewal for additionai, <br />consecutive thirty (30) day terms, <br />Lessees agree to sunrender possession of the premises to Lessor and to promptly vacate said <br />premises on or before March 1, 2013, unless that date is extended by Lessor in writing. Lessor shall <br />issue Notice of Demolition on or before December 1, 2012, vvhich notification shall coincide with <br />the termination date of this Lease, and sha11 provide nofification that the premises must be vacated <br />and that Lessee shall surrender possession of the premises to Lessar not longer than ninety (90) days <br />after issuance of said Notica of Demolition. Notice of Demolition sha11 be effective upon the date <br />that same is hand delivered to and posted upon the Praperty, notwithstanding additional forms of <br />publication and delivery by Lessor. <br />Lessee expressly agrees that if he fails or zefuses to vacate and surrender possession of the <br />Property to Lessor when required to do so by the termination date in this Lease and within ninety <br />(90) days after Notice of Demolition, Lessee sha11 be subject to forfeiture of liqwidated damages in <br />the amount of k'ive Thousand Dollars ($5,000.00), together with such additional damages otherwise <br />provided by law. In addition, Lessee agrees to pay and shall be liable to Lessor thereafter for all <br />attorney fees and other litigation expenses and costs, vvhich Lessor incuxs in any and all necessary <br />actions taken to evict Lessee from the Property. The parties further agree that Lessee may surrender <br />possession of the Property to Lessor, without penalty, at auy time during term of this Lease, provided <br />that Lessor is given written notzce of termination and the premises is vacated.
