1363.11 BUILDING CODE 114 <br />(e) Procedure For Violations of 1363.07(b)(1)(C), 1363.07(b)(1)(D), <br />1363.07(b)(1)(F) and 1363.07(b)(2)(A)(1). Warning tags and citations for violations of these <br />sections shall be written on a pre-printed forms approved by the Property Maintenance Officer, <br />which shall include all information necessary to identify the nature of the violation, the address <br />where it occurred and the owner or operator of the premises at the address. Upon observation <br />of a first violation that is not deemed to be egregious because of similar prior violations at the <br />property within the past 12 months or because of the presence of multiple violations at the <br />property, a warning tag shall be securely placed upon the front entrance to the building. If an <br />egregious condition exists as described above or if the owner or operator of the property fails <br />to correct a citation within forty-eight (48) hours following placement of a warning tag upon <br />the property, citations may be issued by any person employed by the City and <br />specifically designated by the Property Maintenance Officer, and shall then be securely placed <br />upon the front entrance of the building. The owner or operator shall appear at the North <br />Olmsted Building Department to pay the fine for such violation, in person, through a <br />designated representative, or postmarked by mail, within forry-eight hours after the issuance of <br />such real property citation, Sundays or holidays excepted, and pay a fine of thirty-five dollars <br />($35.00), without costs. If such payment is tendered or postmarked more than forty-eight hours <br />after such issuance, Sundays or holidays excepted, then the fine shall be increased to fifty <br />dollars ($50.00), without costs. Voluntary payment of such fine shall not be deemed a formal <br />admission of guilt but shall constitute acknowledgment of the validity of the real property <br />citation and shall preclude the prosecution of the misdemeanor offense alleged therein. <br />(Ord. 2008-44. Passed 5-20-08.) <br />1363.09 EXISTING OFFENSES AND VIOLATIONS NOT DISCHARGED. <br />The repeal of any provision of any other ordinance of the City by this chapter shall not <br />affect any action for prosecution or abatement under any such ordinance or any notice, <br />complaint or order issued by any officer or agency of the City, prior to the effective date <br />hereof or concerning any prosecution or other steps of enforcement which have been taken or <br />are being taken within any administrative agency or in the Municipal Court for enforcement <br />thereof. (Ord. 95-33. Passed 7-5-95.) <br />1363.10 POWERS AND DUTIES OF PROPERTY MAINTENANCE OFFICER. <br />(a) Adoption of Rules and Regulations. The Property Maintenance Officer is <br />hereby authorized to promulgate such written rules and regulations as may be necessary for the <br />proper interpretation and administration of the provisions of this chapter, provided that such <br />rules and regulations do not conflict with this chapter and conform to the general standards <br />prescribed by this chapter. The Property Maintenance Officer shall file copies of such rules <br />and regulations with the Clerk of Council, the City Engineer, the Fire Chief, the Planning, <br />Zoning, Building Codes and Legislation Committee of Council, and shall make available in the <br />Property Maintenance Officer's office a copy for inspection by members of the public during <br />regular business hours. <br />.,^*k <br />",,,0i <br />? <br />. .:? <br />2008 Replacement
