CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2012 - 43 <br />BY: Mayor Kennedy <br />AN ORDINANCE DISPENSING WITH AN RFP PROCESS AND <br />A UTHORIZING THE MA YOR TO ENTER INTO A CONTRACT <br />WITH GARY C. JOHNSON & ASSOCIATES, LLC. PROVIDING FOR <br />THE LATTER TO CONTINUE TO SERVE AS THE CITY'S LABOR <br />NEGOTIATOR, AND DECLARING AN EMERGENCY. <br />WHEREAS, Section 4117.10 of the Ohio Revised Code designates the mayor of a <br />municipal corporation as the official "responsible far negotiations in the collective <br />bargaining process;" and <br />WHEREAS, the law firm of Johnson, Miller & Schmitz, or one of its predecessor <br />law firms [hereinafter "the Johnson law firm"], has since 2002 provided labor negotiator <br />services to the City; and <br />WHEREAS, the Johnson law firm was most recently selected in 2006 through an <br />RFP process authorized by this Council to serve as the City's labor negotiator for the <br />City's labor contracts with terms ending in 2006, 2007 and, through additional legislation, <br />2008; and" <br />WHEREAS, Gary Johnson has represented the City of North Olmsted in its <br />negotiatiuns with the Fraternal Order of Police ("FOP") since December of 2011, after <br />Mr. Johnson's firm was selected in the RFP process in 2011; and <br />WHEREAS, the City has met with the FOP on numerous occasions in the fall of <br />2011 and throughout the winter of 2012; and <br />WHEREAS, the City's negotiating team, in addition to Mr. Johnson, consists of <br />Director of Human Resources Cheryl Farver, Director of Finance Carrie Copfer, Director <br />of Public Safety Scott Thomas and Director of Law Michael Gareau, Jr.; and <br />WHEREAS, despite the exercise of dueldiligence and good faith, the parties have <br />been unable to reach an agreement after meeting numerous times to mediate their <br />differences; and <br />WHEREAS, it is the firm recommendation of the members of the negotiating <br />team that the City continue in its representation with Mr. Johnson given his experience,
