long term involvement with the City of North Olmsted, and the fact that the negotiation is <br />not yet completed; and <br />WHEREAS, the Mayor is satisfied with the services provided by the Johnson law <br />firm and, in the interest of maintaining consistency in management positions by retaining <br />the same labor negotiator, desires to continue to employ the Johnson law firm to serve as <br />the City's labor; and <br />WHEREAS, this Council, acting upon the recommendation of the Mayor, desires <br />to dispense with the RFP process otherwise required by Chapter 112 of the North <br />Olmsted Codified Ordinances and authorize the Mayor to enter into a new contract with <br />the Johnson law firm. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OFNORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the formal RFP process required by Chapter 112 of the <br />Codified Ordinances of the City of North Olmsted is hereby dispensed with by reason of <br />the continuing professional relationship between the City and the law firm of Gary C. <br />Johnson & Associates, LLP, and the Mayor be and he hereby is authorized to enter into a <br />contract with Gary C. Johnson & Associates, LLC. to provide labor negotiator services to <br />the City for the City's labor contracts with terms ending in 2011 and 2012. <br />SECTION 2: That the said contract shall be in final form and substance <br />substantially the same as the Agreement for Labor Negotiator attached to this Ordinance <br />as "Exhibit A," with only such changes thereto in the form and substance of the <br />Agreement that are not substantially adverse to the City. The character of any such <br />changes as not being substantially adverse to the City shall be evidenced conclusively by <br />the execution of the Agreement by the Mayor and the approval of the Agreement by the <br />Director of Law. In addition, the Agreement shall provide for Gary C. Johnson & <br />Associates, LLC. to provide labor negotiator services. <br />SECTION 3: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and <br />for the reason that the City is currently in negotiations; and further provided it receives <br />the affirmative vote of two-thirds of all members of Council, it shall take effect and be in <br />force immediately upon its passage and approval by the Mayor. <br />PASSED: ??-First Reading: (?L <br />Second Reading: ' r <br />Third Reading: til(,.1?1vtle <br />Committee: Q i <br />ATTEST: <br />2
