? after such issuance, Sundays or holidays excepted, then the fine shall be increased to twenty-five <br />? dollars ($25.00), without costs. Voluntary payment of such fine shall not be deemed a formal <br />admission of guilt but shall constitute acknowledgment of the validity of the parking ticket and <br />shall preclude the prosecution of the misdemeanor offense alleged therein. <br />(b) Notwithstanding other fees contained herein, any violator of Section 351.20(b)(1) shall pay <br />a fine of fifty dollars ($50.00) without costs. <br />(c) Unless a different penalty is expressly provided for in another section of this chapter, <br />whoever violates any provision of this chapter shall be guilty of a misdemeanor. If a parking <br />ticket is not paid within a seventy-two hour period pursuant to the procedure provided in <br />paragraph (a), then the Police Department shall issue at least one (1) written communication to <br />the registered owner of the motor vehicle that was issued the parking ticket, at the address of <br />registration on record with the Bureau of Motor Vehicles, and therein advise the registered <br />owner of the unpaid parking ticket. Such written communication shall be forwarded by regular <br />mail and shall further advise that any unpaid parking ticket will be forwarded to the Rocky River <br />Municipal Court, by a date specific, not less than ten (10) days from the date of such <br />correspondence, for further proceedings and prosecution of the parking violation, subject to the <br />imposition of Court costs. Unpaid parking violations may then proceed to Rocky River <br />Municipal Court upon the issuance of a uniform traffic citation and subject to all procedures <br />therein. Such parking violations thereafter shall be subject to the penalties provided in this <br />chapter, or if no specific penalty is provided for a section of this chapter, then in accordance with <br />Section 303.99. <br />SHALL BE AMENDED AND AS AMENDED SHALL READ IN ITS ENTIRETY AS <br />FOLLOWS: <br />351.18 PARKING TICKET PROCEDURES. <br />(a) Parking tickets shall be written on a pre-printed form approved by the Chief of Police, <br />which shall include all information necessary to identify the motor vehicle in violation and its <br />registered owner. Upon observation of a parking violation, parking tickets may be issued by any <br />police officer or auxiliary police officer specifically designated by the Chief of Police, and shall <br />then be securely placed upon the vehicle parked in violation of this chapter, specifically by <br />placing a copy of the parking ticket beneath the windshield wiper on the driver's side of the <br />vehicle. The registered owner of a motor vehicle ticketed for a parking violation shall appear at <br />the North Olmsted Police Department to pay the fine for such parking violation, in person, <br />through a designated representative, or postmarked by mail, within forty-eight hours after the <br />issuance of such parking ticket, Sundays or holidays excepted, and pay a fine of fifteen dollars <br />($15.00), without costs. If such payment is tendered or postmarked more than forty-eight hours <br />after such issuance, Sundays or holidays excepted, then the fine shall be increased to twenty-five <br />dollars ($25.00), without costs. Voluntary payment of such fine shall not be deemed a formal <br />admission of guilt but shall constitute acknowledgment of the validity of the parking ticket and <br />shall preclude the prosecution of the misdemeanor offense alleged therein.
