, <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2013 - 5 <br />BY: Mayor Kennedy <br />AN ORDINANCE AMENDING SECTION 353.07 OF THE TRAFFIC CODE <br />OF THE CITY OF NORTH OLMSTED ENTITLED "PARKING TICKET <br />PROCEDURES" IN ORDER TO ESTABLISH JURISDICTION IN THE <br />NORTH OLMSTED MAYOR'S COURT FOR THE PROSECUTION OF <br />PARKING TICKET VIOLATIONS OCCURRING IN FIRE LANES, AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, the City of North Olmsted Mayor's Court will commence operations on <br />January 1, 2013; and <br />WHEREAS, the Traffic Code presently establishes jurisdiction to administer and <br />prosecute Traffic Code Violations, specifically Fire Lane Parking Tickets, within the Rocky <br />River Municipal Court; and <br />WHEREAS, it is the recommendation of the Administration that Section 353.07 of the <br />Traffic Code of the City of North Olmsted entitled "Parking Ticket Procedure" be amended to <br />create concurrent jurisdiction for prosecution of Fire Lane violations in both Rocky River and the <br />City of North Olmsted Mayor's Court; and <br />WHEREAS, it is the desire of this Council, consistent with the recommendations of the <br />Administration, to establish jurisdiction for such prosecutions in both the Rocky River Municipal <br />Court and the North Olmsted Mayor's Court. <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That section 353.07 of the Traffic Code which presently reads as follows: <br />353.07 PARKING TICKET PROCEDURES. <br />(a) Parking tickets shall be written on a pre-printed form approved by the Chief of Police, <br />which shall include all information necessary to identify the motor vehicle in violation and its <br />registered owner. Upon observation of a parking violation, parking tickets may be issued by any <br />police officer or auxiliary police officer specifically designated by the Chief of Police, and shall <br />then be securely placed upon the vehicle parked in violation of this chapter, specifically by <br />placing a copy of the parking ticket beneath the windshield wiper on the driver's side of the <br />vehicle. The registered owner of a motor vehicle ticketed for a parking violation shall appear at <br />the North Olmsted Police Department to pay the fine for such parking violation, in person, <br />through a designated representative, or postmarked by mail, within forty-eight hours after the <br />issuance of such parking ticket, Sundays or holidays excepted, and pay a fine of fifteen dollars
