Voluntary payment of such fine shall not be deemed a formal <br />admission of guilty but shall constitute acknowledgment of the validity of the parking ticket and <br />shall preclude prosecution of the misdemeanor offense alleged therein. <br />(b) (1) Whoever violates any provision of this chapter shall be guilty of a misdemeanor of <br />the fourth degree. <br />(2) If a parking ticket is not paid within a seventy-two hour period pursuant to the <br />procedure provided in paragraph (a), then the Police Department shall issue at least one (1) <br />written communication to the registered owner of the motor vehicle that was issued the parking <br />ticket, at the address of registration on record with the Bureau of Motor Vehicles, and therein <br />advise the registered owner of the unpaid parking ticket. Such written communication shall be <br />forwarded by regular mail and shall further advise that any unpaid parking ticket will be <br />forwarded to the Rocky River Municipal Court, by a date specific, not less than ten (10) days <br />from the date of such correspondence, for further proceedings and prosecution of the parking <br />violation, subject to the imposition of Court costs. Unpaid parking violations may then proceed <br />to Rocky River Municipal Court upon the issuance of a uniform traffic citation and subject to all <br />procedures therein. Such parking violations thereafter shall be subject to the penalty provided in <br />subsection (b)(1) hereof and all provisions incorporated herein. <br />BE AMENDED AND AS AMENDED SHALL READ IN ITS ENTIRETYAS FOLLOWS: <br />353.07 PARKING TICKET PROCEDURES. <br />(a) Parking tickets shall be written on a pre-printed fortn approved by the Chief of Police, <br />which shall include all information necessary to identify the motor vehicle in violation and its <br />registered owner. Upon observation of a parking violation, parking tickets may be issued by any <br />police officer or auxiliary police officer specifically designated by the Chief of Police, and shall <br />then be securely placed upon the vehicle parked in violation of this chapter, specifically by <br />placing a copy of the parking ticket beneath the windshield wiper on the driver's side of the <br />vehicle. The registered owner of a motor vehicle ticketed for a parking violation shall appear at <br />the North Olmsted Police Department to pay the fine for such parking violation, in person, <br />through a designated representative, or postmarked by mail, within forty-eight hours after the <br />issuance of such parking ticket, Sundays or holidays excepted, and pay a fine of fifteen dollars <br />($15.00), without costs.
