CITY OF NORTA OLMSTED <br />ORDINANCE NO. 2013 - 71 <br />BY: Council Member Orlowski <br />AN ORDINANCE AMENDING SECTION 107.14 OF THE ETHICS <br />CODE IN ORDER TO ELIMINATE THE ETHICS COMMISSION <br />AND TO REFER ALL COMPLAINTS TO THE OHIO ETHICS <br />COMMISSION. <br />yVHEREAS, the Intra-Governmental Committee of City Council reviewed the <br />City Ethics Code and recommended that it be eliminated and that any complaints be <br />referred to the Ohio Ethics Commission; and <br />WHEREAS, it is accordingly the desire of this Council to amend Section 107.14 <br />to eliminate the Ethics Commission and refer all complaints to the State of Ohio. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That Section 107.14 ("Board of Review Established") of the <br />Administrative Code, which presently reads as follows: <br />? 107.14 ETHICS COMMISSION; POWERS AND DUTIES. <br />(a) There is hereby established an Ethics Commission in the City <br />which shall consist of five members, namely, the Director of Finance, the Director <br />of Personnel and Administrative Services, the President of Council and one <br />Councilman at large and one Ward Councilman, both of whom shall be appointed <br />by a majority vote of Council. Neither the Ward Councilman nor the Councilman <br />at large shall be of the same political party, unless all members of Council are of <br />the same political party. The Chairman of the Commission shall be a member of <br />the Commission and shall be chosen by the members of that Commission. The <br />Commission shall meet within thirty days after the effective date of this section to <br />hold an organizational meeting to name its Chairman and further shall hold an <br />organizational meeting in January of each year thereafter. <br />(b) (1) The Ethics Commission established in subsection (a) hereof <br />shall be charged with the duty of investigating any charge of <br />conflict of interest and/or unethical conduct brought against any <br />appointed or elected official, member of any duly constituted <br />committee or commission, or employee of the City, pursuant to <br />this chapter, or any other ordinance adopted by the City. The <br />Commission shall meet within seventy-two hours of a charge of <br />conflict of interest and/or unethical conduct having been made in <br />writing and placed before the Chairman of the Commission. <br />(2) The Commission shall then meet only if a charge of <br />conflict of interest and/or unethical conduct has been made and <br />placed before them. All meetings, except the organizational <br />meeting, shall be private and closed to the public.
