member, or employee of the City, a majority finds probable cause <br />that there is a conflict of interest and/or unethical conduct on the <br />part of an employee, the matter shall be submitted to the Director <br />of Law for advice and opinion. If, after giving his opinion, any <br />two members disagree wrth the Director of Law's opimon, the <br />same shall be so stated and the matter shall be submitted to the <br />Ohio Ethics Commission for a further opinion. Such opinion from <br />the Ohio Ethics Commission shall then be final and conclusive and <br />the provisions of Section 107.13 shall then be invoked if a conflict <br />of interest and/or unethical conduct is found to exist. <br />(c) Any elected or appointed official, member of any duly constituted <br />committee or commission, or employee of the City, or member of the Ethics <br />Commission, either bringing a charge or investigating a charge of conflict of <br />interest and/or unethical conduct shall not reveal any such charge until the Ethics <br />Commission has investigated the matter and issued an opinion on same. Failure <br />to do so, on the part of any of the aforesaid individuals shall constitute a violation <br />of Sections 107.01 and 107.02, and shall be considered to be grounds for <br />disciplinary action under Section 107.13. <br />(d) In the event that any member of the Ethics Commission, or the <br />Director of Law, shall be charged with a conflict of interest and/or unethical <br />conduct, that charge shall be automatically referred to the Ohio Ethics <br />Commission for an opinion. If the Commission finds a conflict of interest and/or <br />unethical conduct to exist, the provisions of Section 107.13 shall then be invoked <br />for appropriate disciplinary action. <br />(Ord. 2005-22.
