Section III <br />Manner of Pertormance of Services <br />North Olmsted Gymnastics agrees to pertorm, at all times faithfully, <br />industriously, and to the best of their ability, experience, and talent, all of the <br />duties that may be required of and from North Olmsted Gymnastics pursuant to <br />the express and implicit terms of this agreement, to the reasonable satisfaction of <br />the City. Such duties shall be rendered at North Olmsted Recreation Complex, <br />and at such other place or places as reasonably necessary for gymnastic <br />instruction, so long as the participants are transported to such offsite locations by <br />and have the permission of parents and/or guardians to participate and that the <br />gymnastics competition, facility and equipment is sanctioned by the Amateur <br />Athletic Union/United States Association of Gymnastics (AAU/USAG), <br />Such responsibilities of North Olmsted Gymnastics shall include, but are not <br />limited to: <br />1. Operate classes only during hours when the Recreation Complex is open. <br />2. Provide information necessary to register, organize, and advertise classes <br />and programs conducted or supervised by Instructor. Such information <br />will include class length, time, cost, and other details as necessary or as <br />demanded by the City. <br />3. Provide proper supervision and qualified instructors for all programs <br />conducted by North Olmsted Gymnastics. All Instructors shall be trained <br />in accordance with the USAG manual and thereby clearly demonstrate <br />knowledge of safety precautions for gymnastics instruction. <br />4. Hire, fire, pay, supervise, and schedule all instructors. <br />5. Refuse to allow participation in classes, lessons, or activities by <br />unregistered or improperly registered persons. <br />6. North Olmsted Gymnastics shall be responsible for maintaining the <br />inventory of all gymnastics equipment. North Olmsted Gymnastics shall <br />reasonably determine, from time to time, whether new equipment is <br />needed in order to maintain the facility as a state of the art facility. North <br />Olmsted Gymnastics shall be responsible for supplying all such necessary <br />equipment, the purchasing thereof, and paying for said equipment in full. <br />City acknowledges that the Instructor is the sole owner of the spring floor. <br />7. Obtain approval from the Recreation Commissioner prior to making <br />changes, alterations, improvements, or additions to the gym area. All <br />such improvements or alterations are fixtures, and shall remain property of <br />the City. <br />8. Insure that all areas of the gym and the equipment are inspected and <br />certified in writing on an annual basis by qualified personnel and <br />immediately provide written notification of said inspection results to the
