? <br />? <br />except in the case of an existing emergency in which case entry may be made at any <br />time and no search warrant is necessary. No person shall refuse to permit such <br />emergency entry or inspection, nor shall any person hinder, obstruct, resist or abuse <br />any person making or attempting to make such entry or inspection. No license shall be <br />issued or renewed if any violation of City Ordinances, the Fire Prevention Code or <br />State law exists. <br />713.06 CONSTRUCTION OR REPAIR PERMIT; <br />APPLICATION AND APPROVAL. <br />(a) Before commencing or proceeding with the erection, construction, alteration or <br />repair of any building or structure or any part thereof, to be used as a rental unit, a <br />building permit therefor shall first be obtained by the owner or his agent or architect <br />from the Building Commissioner. No person shall commence or proceed with any such <br />work unless such permit shall first have been obtained. <br />(b) Application for such building permit shall be made in writing to the Building <br />Commissioner by the owner or his or her agent or architect. Such application shall be <br />accompanied by the plans and drawings and complete information of the building and a <br />satisfactory estimate of cost, for which such application for permit is made, marked <br />thereon. If the specifications accompanying the plans are not complete or are <br />imperfect, the permit shall not be issued. <br />713.07 COMPLIANCE WITH ZONING REGULATIONS. <br />No license or permit shall be granted for the construction or operation of a <br />structure or premises containing rental units in violation of the zoning ordinances or <br />other ordinances of the City. <br />713.08 SUSPENSION OF LICENSE. <br />The Building Commissioner may suspend the license provided for in Section <br />713.03, upon being advised by the Fire Chief, Police Chief or Building Commissioner <br />that such premises are in violation of any provision of this chapter or any other <br />ordinance or resolution of the City. Passed 1-7-69.) <br />713.09 CANCELLATION OF LICENSE; NOTIFICATION. <br />The Building Commissioner may cancel any license issued hereunder and <br />withdraw a certificate of occupancy for any rental unit when a violation of a State law, <br />the Fire Prevention Code, or City ordinance has been found to exist on the premises in <br />excess of thirty days after notice has been sent to the owner of such rental unit. <br />Notification for the purpose of this section shall be by certified or registered mail to the <br />owner at the address shown on the Application required by Section 713.04 or, if no <br />application has been filed, by the Cuyahoga County tax duplicate records. <br />Notwithstanding the requirement of notice provided herein, when in the opinion of the <br />Building Commissioner the condition of the structure or premises, or a part thereof, <br />constitutes an immediate hazard to human life or health, or when a prior violation <br />notice has been sent to the owner or agent for the same or similar violation, then no <br />such notice of violation need be given to the owner or agent of the structure containing
