CITY OF NORTH OLMSTED RESOLUTION NO. 2006 -177 BY: Mayor O'Grady A RESOL UTION A UTHORIZING PAYMENT TO BE MADE TO MEDTRONIC EMERGENCY RESPONSE SYSTEMS, AND RATIFYING AND AFFIRMING THE PURCHASE BY THE NORTH OLMSTED FIRE CHIEF OF A LIFE PAK 12 UNIT FROM SAID COMPANY AND THE TRADE-IN OF AN OLD LIFE PAK UNIT TO SAID COMPANY, AND DECLARING AN EMERGENCY. WHEREAS, the Fire Chief, without complying with either City purchase order procedure or City contract procedure, purchased a new Life Pak 12 Unit from Medtronic Emergency Response Systems for use by the North Olmsted Fire Department and traded in an obsolete Life Pak Unit owned by the City; and WHEREAS, the Director of Finance, in auditing this transaction, determined that she could not legally make payment for said purchase because of the Fire Chiefs failure to comply with City purchase order procedures and/or contract procedures; and WHEREAS, the Director of Finance has certified that sufficient funds have been appropriated by this Council and are available to pay for the said purchase; and WHEREAS, this Council may, pursuant to R.C. Section 5705.41(D), authorize and affirm payment upon such certification by the Director of Finance; and WHEREAS, it is the desire of this Council to authorize and affirm such payment and to ratify the actions taken by the Fire Chief in this matter, including purchasing the said new Life Pak 12 and trading in the obsolete Life Pak Unit owned by the City; NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: SECTION 1: That this Council affirms the certification of the Director of Finance and authorizes her, in accordance with R.C. Section 5705.41(D), to make payment to Medtronic Emergency Response Systems in the amount of Twelve Thousand Seven Hundred Sixty-two Dollars and Forty-two Cents ($12,762.40) for the purchase by the North Olmsted Fire Chief of a Life Pak 12 Unit for the North Olmsted Fire Department.
