? <br />? ,>.. <br />CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2006 -176 <br />BY: The Entire City Council and Mayor O'Grady <br />A RESOLUTION REQUESTING THE STATE OF OHIO <br />ENVIRONMENTAL PROTECTION AGENCY (OEPA) AND THE <br />CITY OF CLEVELAND DIVISION OF AIR QUALITY PROVIDE <br />THE CITY OF NORTH OLMSTED WITH WRITTEN NOTICE OF <br />ALL ACTIONS, HEARINGS, PUBLIC MEETINGS, AND/OR <br />COMPLAINTS REGARDING PERMITS, ODOR OR PAINT BOOTHS <br />AT THE SUBURBAN COLLISION CENTER, LOCATED AT 26618 <br />BROOKPARK ROAD EXTENSION, NORTH OLMSTED, OHIO, AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, the City of North Olmsted, by conditional use permit recommended <br />by the City Planning Commission and approved by City Council on October 18, 2005, <br />authorized Suburban Collision Center to operate a paint booth at its facility located at <br />26618 Brookpark Road Extension, subject to the condition that it conduct an air quality <br />test after one year of operation to insure that no appreciable odors from paint booth fume,. <br />were being dispersed into the residential neighborhood located immediately to the north <br />of the facility; and <br />WHEREAS, since that time, members of the Administration and this City <br />Council have received numerous complaints of paint odor from persons living in the said <br />nearby residential neighborhood; and <br />WHEREAS, this Council has been advised by the City of Cleveland Division of <br />Air Quality that the City of North Olmsted will not receive written notice of actions, <br />hearings, public meetings, or the receipt of complaints by the Cleveland Division of Air <br />Quality regarding permits, odor or the paint booths at the said Suburban Collision Center, <br />unless it specifically requests such notice; and <br />WHEREAS, in order to protect the health, safety and welfare of the North <br />Olmsted community, as well as the quality of life for residents living in the immediate <br />vicinity of the Suburban Collision Center, this Council desires to request, in accordance <br />with the provisions of Chapter 3745 of the Ohio Administrative Code, that the Mayor of <br />the City of North Olmsted and the Clerk of the City Council receive written notice of all <br />actions, hearings, public meetings and/or complaints received by the Ohio EPA and/or <br />the Cleveland Division of Air Quality regarding permits, odor or the paint booths at <br />Suburban Collision Center at 26618 Brookpark Road Extension; <br />NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO:
