Resolution No. 2006-176 SECTION 1: That this Council requests the State of Ohio and/or the City of Cleveland, pursuant to the applicable provisions of Chapter 3745 of the Ohio Administrative Code, provide the City of North Olmsted, through its Mayor and Clerk of Council, with notice in writing of all actions, hearings, public meetings, and complaints received regarding permits, odor or paint booths at Suburban Collision Center, 26618 Brookpark Road Extension, North Olmsted, Ohio 44070. SECTION 2: That the Clerk of Council is directed to transmit a fully signed and attested copy of this Resolution to the Director of the State of Ohio Environmental Agency (Ohio EPA), to the City of Cleveland Department of Public Health, Attn: Commissioner of the Division of Air Quality, and to such other officials or employees of the Ohio EPA and the Cleveland Division of Air Quality as may be necessary in order to effectuate the intent of this Resolution. SECTION 3: That this Resolution is hereby declared to be an emergency measure immediately necessary for the preservation of the public health, safety and welfare, and for the reason that it is necessary that this resolution go into effect immediately so that notice of actions, hearings, public meetings and complaints received regarding the paint booths at Suburban Collision Center may be received by the City in a timely fashion, and further provided it receives the affirmative vote of two-thirds of all members of Council, it shall take effect and be in force immediately upon its passage and approval by the Mayor.
