? <br />? <br />CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2006 -159 <br />BY: Mayor O'Grady <br />? <br />A RESOLUTION AUTHORIZING THE MAYOR TO ENTER INTO THREE <br />CONTRACTS WITH THE CLEVELAND ELECTRIC ILLUMINATING <br />COMPANY PROVIDING FOR THE RELOCATION OF TWO UTILITY <br />POLES AND INSTALLATION OF PERMANENT ELECTRICAL SERVICE <br />TO THE NEW FIRE STATION NO. 2, AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, it is the desire of the Mayor, acting upon the recommendation of the <br />Director of Public Service, to enter into three contracts on behalf of the City of North Olmsted <br />with the Cleveland Electric Illuminating Company for the purpose of relocating two utility poles <br />and the installation of permanent electrical service to the new Fire Station No. 2; and <br />WHEREAS, whereas it is the desire of this Council to so authorize the Mayor to enter <br />into said contracts in order to obtain said services for the benefit of the City; <br />NO W, THEREFORE, BE IT RESOL VED B Y THE CO UNCIL OF THE CITY JF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Mayor be and he is hereby authorized to enter into three contracts <br />with the Cleveland Electric Illuminating Company, for the purpose of relocating two utility poles <br />and providing permanent electrical service to new Fire Station No. 2. Said contracts shall be <br />substantially in the form of the contracts marked as Exhibits A(Relocate 2 poles), B(65% Line <br />Ext. Charge and Concrete Vault), and C(General Service Installation Customer Requested 65% <br />Up-Front Payment Option), attached to this Resolution, and incorporated herein by reference, <br />with only such changes therein as are not substantially adverse to the City and which are <br />approved by the Director of Law. The character of any such changes as not being substantially <br />adverse to the City shall be evidenced conclusively by the execution of the agreement by the <br />Mayor and the approval of the agreement by the Director of Law. <br />SECTION 2: That this Resolution is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public peace, health, safety and welfare, of ".his <br />City and for the further reason that this Resolution is required to be immediately effective so that <br />electrical services necessary for the operation of the new Fire Station may be delivered prior to <br />opening of the station and that the project, necessary for the safety of the community, is not <br />delayed; and further provided it receives the affirmative vote of two-thirds of all members of <br />Council, it shall take effect and be in force immediately upon its passage and approval by the <br />Mayor..
