CITY OF NORTH OLMSTED RESOLUTION NO. 2006 -158 BY: Mayor O'Grady and Council Members Barker and Dailey Jones A RESOLUTION AUTHORIZING THE MAYOR, ON BEHALF OF THE CITY, TO ENTER INTO A REVENUE-GENERATING CONTRACT WITH CAROL HAKY, DBA DAWG POUND HOTDOGS, TO PROVIDE CONCESSION SERVICES AT THE RECREATION COMPLEX AND THE CITY PARKS, AND DECLARING AN EMERGENCY. WHEREAS, in accordance with Section 111.01 of the Codified Ordinances, the Director of Community Life Services advertised for proposals from vendors to provide concession services at the City Recreation Complex and the City parks; and WHEREAS, proposals were received and reviewed by the Director of Community Life Services and the Parks and Recreation Commissioner, and WHEREAS, the Board of Control, on August 29, 2006, recommended that legislation be introduced authorizing the Mayor to enter into a contract with Carol Haky, dba Dawg Pound Hotdogs, to provide concession services at the Recreation Complex and the City Parks; and WHEREAS, it is the desire of this Council to authorize the Mayor to enter into a contract with Carol Haky, dba Dawg Pound Hotdogs, as recommended by the Board of Control; NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: SECTION 1: That this Council hereby authorizes the Mayor to execute, on behalf of the City, a contract with Carol Haky, dba Dawg Pound Hotdogs., to provide concession services at the Recreation Complex and the City Parks. The contract shall be in form and substance in accordance with the Contract for Services, attached hereto as Exhibit A, with only such changes therein as are not substantially adverse to the City and which are approved by the Director of Law. The character of any such changes as not being substantially adverse to the City shall be evidenced conclusively by the execution of the agreement by the Mayor and the approval of the agreement by the Director of Law.
