<br />CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2006 -158 <br />BY: Mayor O'Grady and Council Members Barker and Dailey Jones <br />A RESOLUTION AUTHORIZING THE MAYOR, ON BEHALF OF <br />THE CITY, TO ENTER INTO A REVENUE-GENERATING <br />CONTRACT WITH CAROL HAKY, DBA DAWG POUND HOTDOGS, <br />TO PROVIDE CONCESSION SERVICES AT THE RECREATION <br />COMPLEX AND THE CITY PARKS, AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, in accordance with Section 111.01 of the Codified Ordinances, the <br />Director of Community Life Services advertised for proposals from vendors to provide <br />concession services at the City Recreation Complex and the City parks; and <br />WHEREAS, proposals were received and reviewed by the Director of <br />Community Life Services and the Parks and Recreation Commissioner, and <br />WHEREAS, the Board of Control, on August 29, 2006, recommended that <br />legislation be introduced authorizing the Mayor to enter into a contract with Carol Haky, <br />dba Dawg Pound Hotdogs, to provide concession services at the Recreation Complex and <br />the City Parks; and <br />WHEREAS, it is the desire of this Council to authorize the Mayor to enter into a <br />contract with Carol Haky, dba Dawg Pound Hotdogs, as recommended by the Board of <br />Control; <br />NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That this Council hereby authorizes the Mayor to execute, on <br />behalf of the City, a contract with Carol Haky, dba Dawg Pound Hotdogs., to provide <br />concession services at the Recreation Complex and the City Parks. The contract shall be <br />in form and substance in accordance with the Contract for Services, attached hereto as <br />Exhibit A, with only such changes therein as are not substantially adverse to the City and <br />which are approved by the Director of Law. The character of any such changes as not <br />being substantially adverse to the City shall be evidenced conclusively by the execution <br />of the agreement by the Mayor and the approval of the agreement by the Director of Law.
