<br />Written Agreement Required <br />6.01 This contract may not be modified, amended, supplemented, waived, or rescinded in any <br />manner except by the express written agreement of both the Vendor and the Owner. Any notice <br />by either party to terminate this contract for cause must be provided to the other party in writing <br />at least thirty (30) days in advance of the termination date. The other party may, during said <br />thirty (30) day period, cure the defect, default or other cause for termination which led to the <br />giving of such notice. <br />ARTICLE 7. EQUAL OPPORTUNITY EMPLOYMENT <br />Equal Opportunity Employment <br />7.01 The Vendor will be expected to furnish satisfactory proof to the Owner that they are in full <br />compliance with all applicable Equal Opportunity Employment Laws, whether Federal, State or <br />of the City of North Olmsted. Such satisfactory proof shall be provided at the written request of <br />the Owner no more then ten (10) days from the date of the official request. <br />ARTICLE 8. EXCEPTIONS <br />Special Events and Extenuating Circumstances <br />8.01 The Owner shall have the ability, through express written permission granted to nonprofit <br />groups or organizations, to permit said other groups or organizations to enter into concession <br />agreements with the Owner for the purpose of selling food and non-alcoholic beverages at the <br />City parks or at the Recreation Center under extenuating circumstances or for limited special <br />events. Furthermore, the Owner reserves the right to provide exclusivity of use of its premises <br />under such extenuating circumstances and during such limited special events. <br />ARTICLE 9. REMLTNERATION <br />Remuneration Percentage <br />9.01 The parties agree that Vendor shall pay to the Owner, as compensation for permitting the <br />Vendor to provide concession services at the Recreation Center and City Parks, Six Hundred <br />Dollars ($600.00) each month during the term of this Contract. In addition, the Vendor agrees to <br />pay the Owner additional compensation for catering special events for the City in the amount of <br />twenty percent (20%) of the revenues from such events. <br />Payment Schedule
