CITY OF NORTH OLMSTED ORDINANCE NO. 2006 - 146 BY.• Mayor O'Grady AN ORDINANCE AMENDING SECTION 741.03 OF CHAPTER 741 OF THE BUSINESS REGULATION CODE OF THE CITY OF NORTH OLMSTED, ENTITLED "DELIVERIES TO COMMERCIAL ESTABLISHMENTS, " SO AS TO RENDER THE TIME PERIODS WITHIN WHICH COMMERCIAL DELIVERIES NEAR RESIDENTIAL NEIGHBORHOODS ARE PROHIBITED CONSISTENT WITH THE LOADING AND UNLOADING PROHIBITIONS CONTAINED IN SECTION 555.03(f) OF THE NOISE CONTROL CODE. WHEREAS, this Council previously adopted Ordinance No. 2002-171, providing for amendments to various paragraphs of Section 555.03 of the Noise Control Code, including paragraph (0, which as amended, prohibits loading or unloading boxes, crates, containers, building materials, garbage cans and similar objects, between the hours of 9:00 p.m. and 7:30 a.m., where such activity occurs within 250 feet of a residential building; and WHEREAS, Section 741.03 of Chapter 741 of the Business Regulation Code, entitled "Deliveries to Commercial Establishments," currently prohibits commercial deliveries of any goods or merchandise between the hours of 9:00 p.m. and 7:00 a.m., where such activity occurs within 250 feet of a residential building; and WHEREAS, this Council wishes to establish hours of prohibition for commercial deliveries which are consistent with those found in said Section 555.03( fl of the Noise Control Code; " NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: SECTION 1: That Section 741.03 of Chapter 741 of the Business Regulation Code, entitled "Deliveries to Commercial Establishments," which presently reads as follows: "741.03 PROHIBITIONS. (a) No person shall deliver or cause to be delivered, or accept delivery of, any goods or merchandise to or at a commercial establishment within 250 feet of a residential building between the hours of 9:00 p.m. and 7:00 a.m.
